By letter dated Janauary 6, 1984, the Division of Licensing (DL) staff informed your Company of their approval of your application dated March 9, 1983, and grand d an exemption from the requirements of 10 CFR Part 50, Appendix E, Section IV.F., for the-Oconee and McGuire Nuclear Stations. A Class III fee ($4,000) was remitted with your application pursuant to 10 CFR 170.22.
It is current NRC policy to exempt from fees Appendix E exemptions granted pursuant to 10 CFR 50.12 by the staff of the Division of Licensing unless a license amendment or other approval is also reqmj;'ed. On this basis, fees have not been assessed for any of these types of exemptions.
Therefore, we hays concluded that an exemption, pursuant to 10 CFR 170.11(b), from the fee requirements is authorized by law and such exemption is otherwise in the public interest and is hereby granted for the March 9, 1983 application. We are concurrently authorizing the Division of Accounting and Finance to refund the sum of $4,000 to your Company. It is our understanding that review of this request for the Catawba Nuclear Station will be included as part of the operating license review.
