NOTICE OF VIOLATION

(NRC EXAMINATION REPORT NOS. 50-269/94-300, 50-270/94-300, AND

50-287/94-300)

This refers to the Nuclear Regulatory Commission (NRC) administered

examinations and inspection activities led by Michael E. Ernstes during the

period of March 7-11, 1994. The examinations were administered to employees

of your company who had applied for licenses to operate the Oconee Nuclear

Station. At the conclusion of the examination, the examinations and

preliminary findings were discussed with those members of your staff

identified in the NRC Examination Report, Enclosure 2.

A Simulator Facility Report is included in this report as Enclosure 3. A copy

of the written examination questions and answer key, as noted in Enclosure 6,

was provided to members of your training staff at the conclusion of the

examination.

A copy of the Facility Comments regarding the written examination is included

in this report as Enclosure 4. The NRC Resolution of Facility Comments is

included as Enclosure 5.

Based on the results of this inspection, certain of your activities appeared

to be in violation of NRC requirements, as specified in the enclosed Notice of

Violation (Notice). The violation is of. concern because changes to the

administrative requirements for approval to bypass safety systems without a

procedure should be strictly controlled.

You are required to respond to this letter and should follow the instructions

specified in the enclosed Notice when preparing your response. In your

response, you should document the specific actions taken and any additional

actions you plan to take to prevent recurrence. After reviewing your response

to this Notice, including your proposed corrective actions and the results of

future inspections, the NRC will determine whether further NRC enforcement

action is necessary to ensure compliance with NRC regulatory requirements.

The responses directed by this letter and the enclosed Notice are not subject

to the clearance procedures of the Office of Management and Budget as required

by the Paperwork Reduction Act of 1980, Pub. L. No.96-511.

In accordance with 10 CFR 2.790 of the NRC's "Rules of Practice," a copy of

this letter and its enclosures will be placed in the NRC Public Document Room.
