EXERCISE OF ENFORCEMENT DISCRETION This is to inform the Commission that the staff intends to issue a Notice of Violation for a Severity Level II Violation to Duke Energy Corporation (DEC), but exercise enforcement discretion per Section VI.B.3 of the Enforcement Policy and not issue a Civil Penalty. This action is based on (1) the failure to implement the requirements of 10 CFR 50, Appendix B, Criterion Ill, to incorporate design basis requirements into drawings and procedures; and, (2) the failure to maintain Technical Specification (TS) equipment in an operable condition.
Specifically, DEC failed to ensure that the as-built height configuration of the boric water storage tank (BWST) level instrument taps were adequately incorporated into system design drawings and calibration procedures and failed to incorporate the reactor building (RB) wide range level instrument uncertainties into the emergency operating procedures (EOPs). As a result of this condition, resolution of a conflict between the EOP requirements for initiation of swapover to recirculation during accident scenarios and actual tank and sump level indications, depended heavily on the ability of operators, in a relatively short time period, to recognize the conflict and deviate from the EOP requirements to prevent air entrainment and damage to the high pressure injection (HPI), low pressure injection (LPI) and reactor building spray (BS) systems. The staff has determined that there was not reasonable assurance that the ECCS system could have fulfilled its intended safety function across the full spectrum of break sizes that could result in a loss of coolant accident.
The violation involved a past problem in design. The issues were licensee-identified a part of a self initiated audit, corrective actions were comprehensive and routine licensee efforts were not likely to have identified the deficiencies. Therefore, discretion in accordance with Section VII.B.3 of the Enforcement Policy to refrain from issuing a civil penalty for a Severity Level II violation involving a past problem was exercised.
It should be noted that the licensee has not been specifically informed of the enforcement action. The schedule of issuance and notification is:
