PROPOSED IMPOSITION OF CIVIL PENALTY - $50,000 This is to inform the Commission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $50,000 will be issued on or about March 5, 1996, to Duke Power Company. The action is based on a Severity Level III violation involving the failure to provide adequate procedures to control fuel assembly movement in the spent fuel pool.
This failure is of safety significance in that it resulted in an irradiated fuel assembly being left attached to the fuel bridge mast and withdrawn from its storage location in the spent fuel pool for a period of over three weeks following fuel assembly inspection activities. The assembly could have been uncovered during an accident scenario. The licensee's enforcement history indicated that the violation could have been prevented by the development of appropriate corrective actions in response to previous violations in the area of controlling fuel assembly movement.
In accordance with the Enforcement Policy, a base civil penalty in the amount of
$50,000 is considered for a Severity Level III violation. Because of previous escalated enforcement actions, the staff determined whether the licensee should be given credit for identification and corrective actions. Credit for identification was not warranted because the violation was identified through an event, and the licensee had missed opportunities to discover and correct it. Credit was warranted for corrective actions, which included an in-depth evaluation of the incident, procedural upgrades, management changes, and improvements to training. Therefore, in accordance with the EnforcementfPolicy, a civil penalty in the amount of $50,000 is warranted.
It should be noted that the licensee has not been specifically informed of the enforcement action. The schedule of issuance and notification is:
Mailing of Notice March 5, 1996 Telephone Notification of Licensee March 5, 1996 The State of South Carolina will be notified.
The licensee has thirty days from the date of the Notice in which to respond.
Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
