Oconee Nuclear Station Units 1, 2, and 3 Docket Nos. 50-269, 50-270, and 50 291 License Nos. DPR-38, DPR-47, and DPR-55
Subject:
PROPOSED IMPOSITION OF CIVIL PENALTY - $25,000 This is to inform the Commission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of Twenty-Five Thousand Dollars
($25,000) will be issued on or about December 13, 1988 to Duke Power Company.
This action is based on the licensee's failure to provide adequate procedural guidance to ensure that the high pressure safety injection system would remain operable for all required accident conditions. The escalation and mitigation factors in the Enforcement Policy were considered and the base civil penalty was reduced by 50% because of the licensee's identification and corrective action.
It should be noted that the licensee has not been specifically informed of the enforcement action. The schedule of issuance and notification is:
Mailing of Notice December 13, 1988 Telephone Notification of Licensee December 13, 1988 The State of South Carolina will be notified.
The licensee has thirty days from the date of the Notice in which to respond.
Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
