APPEAL OF THE INITIAL DECISION IN DUKE POWER COMPANY (AMENDMENT TO MATERIALS LICENSE SNM-l 773 FOR OCONEE NUCLEAR STATION SPENT FUEL TRANSPORTATION AND STORAGE AT MCGUIRE NUCLEAR STATION (OCTOBER 31, 1980)
As you are aware, the NRC Staff elected to appeal the McGuire/Oconee spent fuel transportation decision, and on November 10, 1980 exceptions to the Atomic Safety and Licensing Board's Initial Decision were filed. Because the Licensing Board's decision rests primarily upon the factual record presented in this case, we will, of course, need substantial assistance fron your office in properly addressing these matters in our appellate brief.
As a result of his prior involvement in the case, Mr. Brett Spitalny, the Project Manager at the tim this matter was before the Licensing Board, is probably the most knowledgable individual with respect to the background and record facts of the case.
Howinve, we understand that Mr. Spitalny is no longer employed by the Cmission. Because of the importance of this appeal brief, your office may wish to give consideration to obtaining Mr. Spitalny's assistance on a contract basis.
If you decide to retain Mr. Spitalny, his services will be needed on an expedited basis in that the preparation of the appeal brief has begun and we are scheduled to file our brief with the Appeal Board on December 22, 1980.
