JUL 30 1992 MEMORANDUM FOR:

Oscar DeMiranda, Regional Allegations Coordinator, Enforcement and \\Investigations Coordination Staff FROM:

Alan R. Herdt, Chief, Reactor Projects Branch 3, Division of Reactor Projects

SUBJECT:

CLOSEOUT OF ALLEGATION RII-92-A-0031 This allegation was forwarded to Duke Power Company (Duke) by correspondence dated May 20, 1992, from L. Reyes to J. Hampton.

Duke's response to the NRC is dated.July 2, 1992.

This response explains the Employee Assistance Program (EAP) and states that the program has been inspected by the NRC and Duke's audit program. Where deficiencies were identified, they were corrected.

The response acknowledges that the EAP does incur stress on the individual participants in the follow-up program. One purpose of this part of the program is to teach participants how to deal with the stress. As employees progress through the program, complaints are usually resolved.

Based on Duke's response and the successful inspection of the EAP by the NRC, we do not consider that this allegation requires any additional NRC review and can be closed.

Alan R. Herdt
