February 21, 1991 Docket No. 50-270 Distribution See attached list Mr. M. S. Tuckman Vice President Nuclear Operations Duke Power Company P. 0. Box 1007 Charlotte, North Carolina 28201-1007

Dear Mr. Tuckman:

SUBJECT:

REQUEST FOR RELIEF FROM SECTION XI ASME CODE REQUIREMENTS FOR OCONEE NUCLEAR STATION, UNIT 2 (TAC 79191)

In a letter dated December 3, 1990, you requested relief from certain requirements of Section XI of the ASME Code for the Oconee Nuclear Station, Unit 2. The relief request regarded a pinhole leak on a one-inch socket weld pipe cap downstream of valve 2FDW-37. The pipe cap is an ASME Code Class 2 component and a Code repair at this time would require an undesired plant shutdown. The leak has been repaired temporarily by the use of a non-ASME Code engineered mechanical clamp with injection of sealing material. A permanent repair in compliance with ASME code requirements will be performed during the next cold shutdown of Unit 2. The temporary repair was verbally approved by the NRC staff on November 29, 1990.

The staff review of your request concluded that the interim repair is acceptable on the basis that the ASME Code repairs are impractical while the unit is operating and the mechanical clamp was designed with adequate load-bearing capability and that the sealing material is effective for interim leak tight purposes. However, an ultrasonic examination of the adjacent pipe wall should be performed to ensure that no severe deterioration exists beyond the pipe cap region. With this condition, relief from the repair requirements for the specified pipe cap is granted until the next cold shutdown pursuant to 10 CFR 50.55a(g)(6)(i).

This relief is authorized by law and will not endanger life or property or the common defense and security and is otherwise in the public interest given due consideration to the burden that could result if the requirements were imposed on your facility.

Sincerely, David B. Matthews, Director Project Directorate 11-3 Division of Reactor Projects -
