The U.S. Nuclear Regulatory Commission (the Commission) has issued the enclosed Amendment No. 202 to Renewed Facility Operating License No. NPF-12 for the Virgil C.

Summer Nuclear Station, Unit 1, in response to your letter dated July 22, 2015. This amendment revises Technical Specification Section 6.0, "Administrative Controls" by changing the "Shift Supervisor" title to "Shift Manager."

A copy of the related Safety Evaluation is also enclosed. A Notice of Issuance will be included in the Commission's biweekly Federal Register notice.

1. The U.S. Nuclear Regulatory Commission (the Commission) has found that:

A. The application for amendment to the Virgil C. Summer Nuclear Station, Unit 1, (the facility) Renewed Facility Operating License No. NPF-12 filed by the South Carolina Electric & Gas Company (the licensee), dated July 22, 2015, complies with the standards and requirements of the Atomic Energy Act of 1954, as amended (the Act), and the Commission's rules and regulations set forth in 10 CFR Chapter I; B. The facility will operate in conformity with the application; the provisions of the Act, and the rules and regulations of the Commission; C. There is reasonable assurance (i) that the activities authorized by this amendment can be conducted without endangering the health and safety of the public, and (ii) that such activities will be conducted in compliance with the Commission's regulations as set forth in 10 CFR Chapter I; D. The issuance of this amendment will not be inimical to the common defense and security or to the health and safety of the public; and E. The issuance of this amendm.ent is in accordance with 10 CFR Part 51 of the Commission's regulations and all applicable requirements have been satisfied.

2. Accordingly, the license is amended by page changes to the Technical Specifications, as indicated in the attachment to this license amendment; and paragraph 2.C.{2) of Renewed Facility Operating License No. NPF-12 is hereby amended to read as follows:

(2) Technical Specifications and Environmental Protection Plan The Technical Specifications contained in Appendix A, as revised through Amendment No. 202, and the Environmental Protection Plan contained in Appendix B, are hereby incorporated in the license. South Carolina Electric &

Gas Company shall operate the facility in accordance with the Technical Specifications and the Environmental Protection Plan.

3. This amendment is effective as of its date of issuance and shall be implemented within

(3) SCE&G, pursuant to the Act and 10 CFR Part 70, to receive, possess and use at any time special nuclear material as reactor fuel, in accordance with the limitations for storage and amounts required for reactor .

operation, as described in the Final Safety Analysis Report, as amended through Amendment No. 33; *

(4) SCE&G, pursuant to the Act and 10 CFR Parts 30, 40 and 70, to receive, possess arid use at any time any byproduct, source and special nuclear material as sealed neutron sources for reactor startup, sealed neutron sources for reactor instrumentation and radiation monitoring equipment calibration, and as fission detectors in amounts as required; (5) SCE&G, pursuant to the Act and 10 CFR Parts 30, 40 and 70, to receive, possess and use in amounts as required any byproduct, source or special nuclear material without restriction to chemical or physical form, for sample analysis or instrument calibration or associated with radioactive apparatus or components; and (6) SCE&G, pursuant to the Act and 10 CFR Parts 30, 40 and 70, to possess, but not separate, such byproduct and special nuclear materials as may be produced by the operation of the facility.

C. This renewed license shall be deemed to contain, and is subject to, the conditions specified in the Commission's regulations set forth in 10 CFR Chapter I and is subject to all applicable provisions of the Act and to the rules, regulations, and orders of the Commission now or hereafter in. effect; and is

  • subject to the additional conditions specified or incorporated below:

(1) Maximum Power Level SCE&G is authorized to operate the facility at reactor core power levels not in excess of 2900 megawatts thermal in accordance with the conditions specified herein and in Attachment 1 to this renewed license.

The preoperational tests, startup tests and other items identified in Attachment 1 to this renewed license shall be completed as specified.

Attachment 1 is hereby incorporated into this license.

(2) Technical Specifications and Environmental Protection Plan The Technical Specifications contained in Appendix A, as revised through Amendment No. 202, and the Environmental Protection Plan contained in Appendix B, are hereby incorporated in the license. South Carolina Electric & Gas Company shall operate the facility in accordance with the Technical Specifications and the Environmental Protection Plan.

6.0. ADMINISTRATIVE CONTROLS 6.1 RESPONSIBILITY 6.1.1 The General Manager, Nuclear Plant Operations shall be responsible for overall unit operation and shall delegate in writing the succession to this responsibility during his absence.

6.1.2 The Shift Manager shall be responsible for unit operations. A management directive to this effect, signed by the Vice President, Nuclear Operations, shall be reissued to all station personnel on an annual basis.

6.2 ORGANIZATION 6.2.1 OFFSITE AND ONSITE ORGANIZATIONS Offsite and Onsite organizations shall be established for unit operation and corporate management, respectively. The offsite and onsite organizations shall include the positions for activities affecting the safety of the nuclear power plant.

a. Lines of authority, responsibility and communication shall be established and defined from the highest levels through intermediate levels to and including all operating organization positions. Those relationships shall be documented and updated, as appropriate, in the form of organizational charts, functional descriptions of department responsibilities and relationships, and job descriptions for key personnel positions, or in equivalent forms of documentation. The organizational charts will be documented in the FSAR and updated in accordance with 10 CFR 50.71 (e).
b. The General Manager, Nuclear Plant Operations, shall be responsible for overall unit safe operation arid shall have control over onsite activities necessary for safe operation and maintenance of the plant.
c. The Vice President, Nuclear Operations, shall have corporate responsibility for overall plant nuclear safety and shall take any measures needed to ensure acceptable performance of the staff in operating, maintaining, and providing technical support to the plant to ensure nuclear safety.
d. The individuals who train the operating staff and those who carry out the health physics and quality assurance functions may report to the appropriate onsite manager; however, they shall have sufficient organizational freedom to ensure their independence from operating pressures.

6.2.2 UNIT STAFF

a. Each on-duty shift shall be composed of at least the minimum shift crew composition shown in Table 6.2-1.

During any absence of the Shift Manager from the Control Room while the unit is in MODE 5 or 6, an individual with a valid R9 or SRO license shall be designated to assume the Control Room command function.

  • 6.3 UNIT STAFF QUALIFICATIONS 6.3.1 Each member of the unit staff shall meet or exceed the minimum qualifications of ANSI N18.1-1971 for comparable positions except for the Radiation Protection Manager who shall meet or exceed the qualifications of Regulatory Guide 1.8, September 1975.

ADMINISTRATIVE CONTROLS 6.12.2 In addition to the requirements of 6.12.1, areas accessible to personnel with radiation levels greater than 1000 mrem/hr* but less than 500 rads/hr** shall be provided with locked doors to prevent unauthorized entry, and the keys shall be maintained under the administrative control of the duty Shift Manager and/or health physics supervision. Doors shall remain locked except during periods of access by personnel under an approved RWP which shall specify the dose rate levels in the immediate work area. The maximum allowable stay time for individuals in that area shall be established prior to entry. In lieu of the stay time specification of the RWP, direct or remote continuous surveillance (such as closed circuit TV cameras) shall be made by personnel qualified in radiation protection procedures to provide positive exposure control over the activities within the area.

For individual areas accessible to personnel with radiation levels greater than 1000 mrem/hr* but less than 500 rads/hr** that are located within larger areas (such as PWR containment) where no enclosure can be reasonably constructed around the individual areas, then those areas shall be barricaded, conspicuously posted, and a flashing light shall be activated as a warning device.

6. 13 PROCESS CONTROL PROGRAM (PCP) 6.13.1
  • The PCP shall be approved by the Commission prior to implementation.

6.13.2 Changes to the PCP:

a. Shall be documented and records of reviews performed shall be retained for the durati.on of the Unit Operating License. This documentation shall contain:
1) Sufficient information to support the change together with the appropriate analyses or evaluations justifying the change(s); and
2) A determination that the change will maintain the overall conformance of the solidified waste product to existing requirements of Federal, State, or other applicable regulations.
b. Shall become effective after review and acceptance by the PSRC and approval of the General Manager, Nuclear Plant Operations.
  • Measurement made at 30 cm (12 in.) from the radiation source or from any surface penetrated by the radiation.
    • Measurement made at 1 meter from the radiation source or from any surface penetrated by the radiation.

NPF-12 SOUTH CAROLINA ELECTRIC & GAS COMPANY SOUTH CAROLINA PUBLIC SERVICE AUTHORITY VIRGIL C. SUMMER NUCLEAR STATION, UNIT 1 DOCKET NO. 50-395 1.0

  • INTRODUCTION By letter dated July 22, 2015 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML15205A291 ), South Carolina Electric & Gas Company (SCE&G, the licensee) submitted a request to revise Technical Specification (TS) Section 6.0, "Administrative Controls" by changing the "Shift Supervisor" title to "Shift Manager." The licen~ee stated that the proposed changes are administrative in nature and based on recommendations from the Institute of Nuclear Power Operations (INPO) within INPO's Significant Operating Experience Report (SOER) 96-1, "Control Room Supervision Operational Decision-Making and Teamwork."

2.0 REGULATORY EVALUATION

Title 10 of the Code of Federal Regulations (10 CFR) 50.36, "Technical Specifications," provides the regulatory requirements for the contents in a licensee's TSs. Section 50.36(c) requires that the TSs include items in the following categories: (1) safety limits, limiting safety system settings, and limiting control settings; (2) limiting conditions for operation (LCO); (3) surveillance requirements (SRs); (4) design features; and (5) administrative controls. In 10 CFR 50.36(c)(5),

"Administrative controls," it is stated that "Administrative controls are the provisions relating to organization and management, procedures, recordkeeping, review and audit, and reporting necessary to assure operation of the facility in a safe manner." Therefore, the position title and department name in TS 6.0 must reflect the organization operating the facility.

In 10 CFR 50.54, "Conditions of licenses," paragraph I states, 'The licensee shall designate individuals to be responsible for directing the licensed activities of licensed operators. These individuals shall be licensed pursuant to part 55 of this chapter." The proposed change pertains to plant staff in a supervisory or management position.

3.0 TECHNICAL EVALUATION

The licensee requested to revise multiple areas in TS Section 6.0, "Administrative Controls,"

from the position title "Shift Supervisor" to "Shift Manager." Specifically, the title of Shift Supervisor is being changed to Shift Manager in TS Sections 6.1.2, Table 6.2-1, 6.2.4, and 6.12.2. In addition, the abbreviations will be changed from "SS" to "SM" in Table 6.2-1, where applicable. SCE&G stated in its license amendment request that the purpose of the title change is to emphasize the scope and significance of the responsibilities for this position. Additionally, the licensee stated the change will not lower the effectiveness of the organization.

The U.S. Nuclear Regulatory Commission (NRC) has approved a title change from the generic position title "Shift Supervisor" to "Shift Manager" for the Calloway Plant in July 11, 2006 (ADAMS Accession No. ML061250207). The NRC staff has previously determined that this change is administrative in nature.

The proposed amendment does not 'change the requirements in TS, or the plant staff qualifications, functions, responsibilities, and authorizations as required by 10 CFR 50.36 and 10 CFR 50.54(1). Based on the above, the NRC staff concludes that the proposed amendment is admini~trative in nature, and therefore finds it acceptable.

4.0 STATE CONSULTATION

In accordance with the Commission's regulations, the South Carolina State official was notified of the proposed issuance of the amendment. The State official had no comments.

5.0 ENVIRONMENTAL CONSIDERATION

The amendment relates to changes in recordkeeping, reporting, or administrative procedures or requirements. Accordingly, the amendment meets the eligibility criteria for categorical exclusion set forth in 10 CFR 51.22(c)(10). Pursuant to 10 CFR 51.22(b), no environmental impact statement or environmental assessment need be prepared in connection with the issuance of the amendment.

6.0 CONCLUSION

The Commission has concluded, based on the considerations discussed above, that: (1) there is reasonable assurance that the health and safety of the public will not be endangered by

. operation in the proposed manner, (2) there is reasonable assurance that such activities will be conducted in compliance with the Commission's regulations, and (3) the issuance of the amendments will not be inimical.to the common defense and security or to the health and safety of the public.
