NOTICE AND ORDER (Scheduling and Providing Instructions for Oral Argument)
On May 18, 2015, the State of New York petitioned to intervene in this proceeding concerning an operating license amendment request (LAR) submitted by Entergy Nuclear Operations, Inc. (Entergy) for Indian Point Unit 2.1 New York proffered two contentions.2 Because oral argument will assist the Board in determining the admissibility of New Yorks contentions, oral argument will be held on July 30, 2015 at 1:00 PM EDT, in the Atomic Safety and Licensing Board Panels Hearing Room, located in the Nuclear Regulatory Commissions Headquarters at 11555 Rockville Pike, Rockville, Maryland 20852.3 All participants, as well as members of the public who wish to observe, should arrive at least 15 1 See State of New York Petition to Intervene and Request for Hearing (May 18, 2015)

minutes early to pass through security at One White Flint North and proceed to the Hearing Room, located on the third floor of Two White Flint North.
The Board will hear argument in the following order: (1) New York; (2) Entergy; and (3) the NRC Staff. New York will have one hour of argument time. Entergy and the NRC Staff will each have 45 minutes of argument time. New York may elect to reserve a portion of its allotted argument time for rebuttal. No other rebuttal will be permitted.
Participants should be prepared to answer the Boards questions concerning the following, non-exclusive, list of topics.
Risk assessment methodologies Determination of significant vs. small risk Relevance of seismic hazard analysis The on-going harm and or risk alleged from the operating history of the primary reactor containment of Indian Point Unit 2 The Integrated Leak Rate Test acceptance criteria Monitoring of inaccessible degradation-susceptible areas On or before July 23, 2015, New York, Entergy, and the NRC Staff shall provide by email to the Board and service list the name of counsel who will present oral argument. No witnesses, other representatives of the parties, or members of the public will be heard during the argument.
