Mr. Hassoun, Pursuant to Title 10 of the Code of Federal Regulations (10 CFR) 50.55a(z), alternatives to the requirements may be used when authorized by the U.S. Nuclear Regulatory Commission (NRC) if the licensee demonstrates that (i) the proposed alternative would provide an acceptable level of quality and safety or (ii) compliance with the specified requirements would result in hardship or unusual difficulty without a compensating increase in the level of quality and safety.

Pursuant to 10 CFR 50.55a(f)(5)(iii), if the licensee has determined that conformance with certain Code requirements is impractical for the facility, the licensee must notify NRC and submit information to support the determination. Pursuant to 10 CFR 50.55a(f)(6)(i) the NRC will evaluate the licensees determination that the code requirements are impractical. The NRC may grant relief or may impose such alternative requirements.

In the Subject request dated March 5, 2015, DTE Electric Company is seeking NRC authorization in accordance with 10 CFR 50.55a(z)(1), based on the proposed alternative would provide an acceptable level of quality and safety.

Upon review of the Subject request, the NRC staff is informing you that it will be reviewing the Subject relief request under 10 CFR 50.55a(f)(5)(iii), and not the section proposed in the request.
