ACE - Document Received During the Limerick AAM - [EDATS R1-2015-0195]

Dear Mrs. Cuthbert (ACE),

On May 21, 2015, the U. S. Nuclear Regulatory Commission (NRC) conducted a public open house at the Limerick Township Municipal Building in Limerick, PA. The NRC conducted the Annual Assessment Meeting (AAM) open house to discuss its assessment of the safety performance at Limerick Generating Station (LGS), Units 1 and 2 for 2014. During this meeting, the Alliance for a Clean Environment (ACE) provided the NRC staff with a 40 page document.

Our responses to issues in this document are provided below.

ADAMS Record In the document that ACE submitted to the NRC staff at the LGS AAM, ACE requested posting the document on the NRCs website for public review. As noted in the LGS AAM meeting summary (ML15147A615) this ACE document was placed into the NRCs Agencywide Documents Access and Management System (ADAMS) as a public record and was given ADAMS Accession Number ML15146A226. Publically available ADAMS documents can be located by entering the accession number (ML) into the search box in the upper right corner of our homepage at www.nrc.gov.

Staff Conduct Since the ACE document made a number of assertions regarding improper conduct by NRC staff, this document was screened by the Regional Counsel in the NRCs Region I office and was referred to the NRCs Office of the Inspector General. Further information regarding the Office of the Inspector General is available at the following link: http://www.nrc.gov/insp-gen.html Allegations Safety concerns associated with NRC licensed facilities can be addressed through the NRCs allegation program. The ACE document will be screened by staff in the Region I office for safety concerns that could be considered allegations. The NRCs regulations in 10 CFR 2.206 describe the petition process, which is the primary mechanism for the public to request enforcement-related action by the NRC in a public process. This process permits anyone to petition the NRC to take enforcement-related action associated with NRC licensees or licensed activities. Depending on the results of its evaluation, NRC could modify, suspend or revoke an NRC-issued license or take any other appropriate enforcement-related action to resolve a problem.

Although the document that ACE provided at the LGS AAM expressed skepticism of the 10 CFR 2.206 process, it also made numerous requests for enforcement-related action (i.e.,

ACEs request to revoke Limericks operating license). The NRC staff has previously offered ACE the use of the petition process to address concerns where enforcement-related action was requested (e.g., NRC e-mail dated April 23, 2014 (ADAMS Accession No. ML14129A184)).

However, ACE has previously rejected use of the NRCs petition process to address its concerns (e.g.,

letter dated July 25, 2014 (ADAMS Accession No. ML14216A339)). Nevertheless, the NRC staff continues to consider the 10 CFR 2.206 petition process to be the appropriate process to address requested enforcement-related actions. The NRCs petition process is available if ACE disagrees with the NRCs findings and has information the NRC did not consider in making its findings.
