Dear Sir/Madam:
By letter dated May 9, 2014 (Reference 1) Duke Energy Progress, Inc. submitted a request for relief from the requirements of paragraph IWA-2441 (b) of American Society of Engineers (ASME) Boiler and Pressure Vessel (B&PV) Code,Section XI, 2007 edition through the 2008 Addenda. Duke Energy staff review of the changes resulting from Regulatory Guide (RG) 1.147, Revision 17, and the ASME Applicability Index for Code Cases published in the Federal Register (Volume 79, Issue 214) on November 5, 2014 and effective on December 5, 2014 concluded that Code Case N-532-5 is applicable through the 2010 Edition of ASME B&PV Code, Section Xl. Based on this conclusion Duke Energy Progress will not pursue relief as requested by means of reference 1 aind,by this letter, withdraws relief request RR-1 0.
