Thadani (U.S. Nuclear Regulatory Commission) to Exelon Generation Company, LLC, "RE: Preemption Authority for Exelon Generation's Northeast Plants," dated January 13, 2015 In Reference 1, NRC designated an interim class of licensed facilities eligible to apply for preemption authority to allow the possession and use of firearms, ammunition, and other devices such as large-capacity ammunition feeding devices, notwithstanding local, State, and certain Federal firearms laws that may prohibit such possession and use. In Reference 2, Constellation Energy Nuclear Group (CENG) applied for Commission approval to use the preemption authority allowed by Section 161 a of the Atomic Energy Act for its licensed facilities at Calvert Cliffs Nuclear Power Plant, Nine Mile Point Nuclear Power Station, and the R.E.

Ginna Nuclear Power Plant.

In the Reference 3 letter, the U.S. Nuclear Regulatory Commission requested additional information. Reference 4 was our response. In References 5 and 6, the U.S. Nuclear Regulatory Commission requested signature of the Consent and Hearing Waiver Form for Nine Mile Point Nuclear Station and R.E. Ginna Nuclear Power Plant. Attached are the signed forms.

By signing below, Exelon Generation Company, LLC, consents to the issuance of the referenced Confirmatory Order, by doing so, agrees to waive the right to request a hearing on all or any part of the Confirmatory Order.
