Dear Mr. Vu,

By letter dated January 28, 2014 (Agencywide Document Access and Management System Accession Number ML14043A167), Duke Energy Carolinas, LLC (Duke Energy), submitted a license amendment request (LAR) to revise the Technical Specifications (TSs) for the McGuire Nuclear Station, Units 1 and 2. The proposed LAR would modify TS 3.4.12 for the Low Temperature Overpressure Protection (LTOP) System to remove the reference to Condition E when entering Condition G.

The NRC staff has reviewed the LAR and has determined that additional information is needed to complete its review. The NRC staffs draft Request for Additional Information (RAI) for the subject LAR is attached to this e-mail. The draft RAI is not an official NRC staff request and is being provided to you to facilitate a subsequent conference call to determine: 1) If the questions clearly convey the NRC staff information needs; 2) Whether the regulatory basis for the questions is understood; and 3) Whether the information is already available in existing, docketed correspondence. REQUEST FOR ADDITIONAL INFORMATION MCGUIRE NUCLEAR STATION, UNITS 1 & 2 REQUESTED REVISIONS TO TECHNICAL SPECIFICATION 3.4.12 LOW TEMPERATURE OVERPRESSURE PROTECTION SYSTEM DUKE ENERGY CAROLINAS, LLC DOCKET NOS. 50-369 AND 50-370 TAC NO. MF3444 By letter dated January 28, 2014, Duke Energy Carolinas, LLC (Duke Energy), the licensee for McGuire Nuclear Station, Units 1 and 2 (McGuire), requested to revise the McGuire Technical Specifications (TSs) (Agencywide Document Access and Management System (ADAMS)

Accession Number ML14043A167). The proposed revision would modify TS 3.4.12 for the Low Temperature Overpressure Protection (LTOP) System to remove the reference to Condition E when entering Condition G.

Based on the review of the amendment request, the NRC staff has determined that additional information is required regarding modifying TS 3.4.12 for the LTOP System to remove the reference to Condition E when entering Condition G.

SRXB - RAI 1 TS 3.4.12 Condition G for McGuire Units 1 and 2 states the following, Two PORVS inoperable OR Required Action and associated Completion Time of Condition C, D, E, or F not met OR LTOP System inoperable for any reason other than Condition A, B, C, D, E, or F.

Condition A for McGuire Units 1 and 2 contains the following conditions, Two centrifugal charging pumps capable of injecting into the [Reactor Coolant System] RCS. OR One centrifugal charging pump and one safety injection pump capable of injecting into the RCS. OR Two safety injection pumps capable of injecting into the RCS.

When compared to Condition G in Westinghouse Standard Technical Specifications (STSs),

Condition G states that Required Action and associated Completion Time of Condition A, [B,]

D, E, or F not met. Please provide justification for why McGuire Units 1 and 2 TS 3.4.12 Condition G does not contain Condition A for its Required Actions and associated Completion Time.

SRXB - RAI 2 TS 3.4.12 Condition F for McGuire Units 1 and 2 states that when the Required Action and associated Completion Time of Condition E is not met then (1) verify RCS cold leg temperature

> 174 oF (Unit 1) or > 89 oF (Unit 2) AND (2) verify Residual Heat Removal (RHR) suction relief valve is OPERABLE and the suction isolation valves are open. Westinghouse STS Condition F requires that if one required relief valve is inoperable in MODE 5 or 6, then restore the required RCS relief valve to OPERABLE status. The Westinghouse STS Condition F for TS 3.4.12 is equivalent to the McGuire TS 3.4.12 Condition E.

Please provide an explanation for the additional TS in McGuire TS 3.4.12 Condition F as being unique compared to the Westinghouse STS TS 3.4.12.

SRXB - RAI 3 TS 3.4.12 Required Actions A.2.1 and F.2 for McGuire Units 1 and 2 credit the RHR suction relief valve. Limiting Condition for Operation (LCO) 3.4.12 states the following:

An LTOP System shall be OPERABLE with a maximum of one centrifugal charging pump or one safety injection pump capable of injecting into the RCS and the accumulators isolated and either a or b below:

a. Two power operated relief valves (PORVs) with lift setting 385 psig or
b. The RCS depressurized and an RCS vent of 2.75 square inches.

Please provide an explanation for why the RHR suction relief valve is credited in TS 3.4.12 Required Actions A.2.1 and F.2 while not being credited or listed under LCO 3.4.12.

SRXB - RAI 4 TS 3.4.12 Conditions A and F credit the RHR suction relief valve under the required actions.

Neither the relief capability nor vent size for the RHR suction relief valve is listed in Required Actions A 2.1 or F.2, while Required Actions A.4, A.5.1, and G.1 specify the capabilities of the credited relief vents. Please provide the RHR suction relief valve capability and vent size for TS 3.4.12, Required Actions A 2.1 or F.2.
