Enclosure UNITED STATES NUCLEAR REGULATORY COMMISSION RENEWAL OF FACILITY OPERATING LICENSE DOCKET NO. 50-131 DEPARTMENT OF VETERANS AFFAIRS NEBRASKA - WESTERN IOWA HEALTH CARE SYSTEM ALAN J. BLOTCKY REACTOR FACILITY Amendment No. 12 License No. R-57
- 1. The U.S. Nuclear Regulatory Commission (the Commission) has found that:
A. The decommissioning plan and application for amendment of Facility Operating License No. R-57 filed by the Department of Veterans Affairs, Nebraska - Western Iowa Health Care System (the licensee) dated May 21, 2014, as supplemented on November 12, 2014, complies with the standards and requirements of the Atomic Energy Act of 1954, as amended (the Act), and the Commission's rules and regulations set forth in 10 CFR Chapter I; B. Construction of the Alan J. Blotcky Reactor Facility (the facility) was completed in substantial conformity with Construction Permit No. CPRR-36 dated June 24, 1959, the provisions of the Act, and the rules and regulations of the Commission; C. The facility will be possessed in conformity with the application, the provisions of the Act, and the rules and regulations of the Commission; D. There is reasonable assurance: (i) that the activities authorized by this amendment can be conducted without endangering the health and safety of the public, and (ii) that such activities will be conducted in compliance with the Commission's rules and regulations; E. The licensee is technically and financially qualified to engage in the activities authorized by this license in accordance with the rules and regulations of the Commission; F. The licensee is a Federal Agency which will use the facility for the conduct of educational training and academic research purposes, and need not furnish proof of financial protection as would otherwise be required by subsection 170a of the Act; G. The issuance of this license will not be inimical to the common defense and security or to the health and safety of the public;

H. The issuance of this license is in accordance with 10 CFR Part 51 of the Commission's regulations and all applicable requirements have been satisfied; and I. The possession of the byproduct as authorized by this license will be in accordance with the Commission's regulations in 10 CFR Parts 30, including Section 30.33.
- 2. Facility License No. R-57 is hereby amended in its entirety to read as follows:
A. The license applies to the TRIGA nuclear research reactor located at the Alan J. Blotcky Reactor Facility owned by the Department of Veterans Affairs, Nebraska - Western Iowa Health Care System. The facility is located at the Nebraska - Western Iowa Health Care System, Omaha Division (formerly known as the VA Medical Center Omaha) in Omaha, Douglas County, Nebraska, and is described in the licensee's amendment application for renewal of the license dated May 10, 1993, as supplemented.
B. Subject to the conditions and requirements incorporated herein, the Commission hereby licenses the Department of Veterans Affairs, Nebraska - Western Iowa Health Care System:
(1) Pursuant to Section 104c of the Act and 10 CFR Part 50, "Domestic Licensing of Production and Utilization Facilities," to possess the facility at the designated location in Omaha, Douglas County, Nebraska, in accordance with the procedures and limitations described in the application and set forth in this license; (2) deleted (3) Pursuant to the Act and 10 CFR Part 30, "Rules of General Applicability to Domestic Licensing of Byproduct Material," to possess:
- a. Up to 8 curies of polonium-beryllium in the form of sealed sources;
- b. deleted
- c. deleted
- d. deleted
- e. To possess byproduct material produced during the operation of the facility.

This license shall be deemed to contain and is subject to the conditions specified in Parts 20, 30, Part 50, 51, 55 of 10 CFR to all applicable provisions of the Act, and to the rules, regulations and orders of the Commission now, or hereafter in effect, and to the additional conditions specified below:
(1) Maximum Power Level The licensee may not operate the reactor.
(2) Technical Specifications The Technical Specifications contained in Appendix A, Amendment No. 11, as issued on August 5, 2002, as are incorporated in the license. The licensee shall possess the facility in accordance with the Technical Specifications.
D.
Decommissioning (1) The license is amended to approve the decommissioning plan described in the licensees application dated May 21, 2014, as supplemented on November 12, 2014, and authorizes inclusion of the decommissioning plan as a supplement to the Safety Analysis Report pursuant to 10 CFR 50.82(b)(5);
(2) The licensee may make changes to the decommissioning plan without prior approval provided the proposed changes do not:
- a. Require Commission approval pursuant to 10 CFR 50.59;
- b. Use a statistical test other than the Sign test or Wilcoxon Rank Sum test for evaluation of the final status survey;
- c. Increase the radioactivity level, relative to the applicable derived concentration guideline level, at which an investigation occurs;
- d. Reduce the coverage requirements for scan measurements;
- e. Decrease an area classification (i.e., impacted to unimpacted; Class 1 to Class 2; Class 2 to Class 3; or Class 1 to Class 3);
- f. Increase the Type I decision error;
- g. Increase the derived concentration guideline levels and related minimum detectable concentrations (for both scan and fixed measurement methods);
- h. Result in significant environmental impacts not previously reviewed.
(3) The licensee shall submit reports of all characterization surveys performed that were not part of the license amendment application to justify the classification of areas that were not accessible. These reports shall be submitted for review prior to performing the final status survey.

This license is effective as of the date of issuance and shall expire twenty years from its date of issuance.
