Dear Mr. Melius,

Mr. Clark, and Ms. Finfera:

The U.S. Nuclear Regulatory Commission (NRC) has completed the enclosed final Supplement 52 to NUREG-1437, Generic Environmental Impact Statement for License Renewal of Nuclear Plants (SEIS), regarding the license renewal of Davis-Besse Nuclear Power Station, Unit 1 (Davis-Besse), in accordance with the National Environmental Policy Act of 1969, as amended (NEPA). With this letter, I am forwarding you a copy of the final SEIS.

As part of its NEPA review, the NRC considered effects to species and habitats protected under the Endangered Species Act of 1973, as amended (ESA), and in a letter dated February 27, 2014, the NRC requested the U.S. Fish and Wildlife Services (FWS) concurrence with its biological assessment for the proposed license renewal in accordance with ESA section 7.

During consultation, the NRC determined that continued operation of Davis-Besse during the license renewal term may affect, but is not likely to adversely affect the Kirtlands warbler (Setophaga kirtlandii), piping plover (Charadrius melodus), red knot (Calidris canutus rufa),

Indiana bat (Myotis sodalis), and northern long-eared bat (Myotis septentrionalis) and would have no effect on the eastern prairie fringed orchid (Platanthera leucophaea) or lakeside daisy (Hymenoxy acaulis var. glabra).

Clark, and In a letter dated September 30, 2014, the FWS concurred with the NRCs effect determinations and indicated that formal consultation between the FWS and NRC pursuant to ESA section 7 would not be necessary for the proposed license renewal. The NRC has documented the FWSs concurrence and the conclusion of consultation in Section 4.8.1 of the final SEIS. The FWSs letter also included non-ESA comments on the draft SEIS. You will find the NRCs responses to those comments in Appendix A of the final SEIS and associated text changes, as applicable, in Section 4.8 of the final SEIS. In preparing the final SEIS, the NRC staff did not identify any new information that would change the staffs findings of no effect or that would otherwise require initiation of section 7 consultation. Accordingly, the NRC considers its obligations under ESA section 7 for the proposed license renewal of Davis-Besse to be fulfilled.

I look forward to future coordination with your offices to ensure the continued protection of Federally listed species and designated critical habitats at Davis-Besse and other NRC-licensed operating nuclear plants in your respective regions.
