Research Reactor ) ASLBP No. 14-931-01-LT-BD01 MOTION TO CORRECT TRANSCRIPT FROM AUGUST 12, 2014 HEARING On August 12, 2014, a hearing was held in the above-captioned matter and a hearing transcript was issued for review on August 13, 2014.1 As directed by the Presiding Officer, Aerotest Operations, Inc. and Nuclear Labyrinth, LLC (the Companies) reviewed the transcripts and with the NRC Staff jointly submitted proposed transcript corrections.2 During review of the transcript, Mr. Michael Anderson identified that he provided an incorrect answer to a question posed by Judge Hawkins because he misunderstood the question posed. The Companies hereby move to correct the transcript. This motion is supported by Mr. Andersons Affidavit included as Attachment 1.
The particular question and response are provided in the transcript at page 75, lines 11-15:
JUDGE HAWKENS: And at the time of the denial it was still uncertain when the reactor could return to service, in part because of the damaged fuel. Is that correct?
MR. ANDERSON: I believe thats correct.

Mr. Anderson understood the question to be related to the Staff position on the return to service date. Based on that understanding, Mr. Andersons answer at page 75, line 15 should have been:
I believe that is a correct statement of the Staffs position. The Companies respectfully request that this response be corrected as provided herein.
I hereby certify that I have consulted with the NRC Staff on this transcript correction and the NRC Staff stated that they object to this change and requested that a motion be submitted allowing them to respond on the record.

- 1. I, Michael S. Anderson, state that in my review of the August 12, 2014 hearing transcript, I realized that I had misunderstood a question posed by Judge Hawkins and therefore provided an incorrect answer.
- 2. The particular question and response are provided at page 75, lines 11-15:
