AVAILABILITY OF THE FINAL SUPPLEMENTAL ENVIRONMENTAL IMPACT STATEMENT REGARDING LIMERICK GENERATING STATION, UNITS 1 AND 2, LICENSE RENEWAL
Dear Ms. Colligan and Mr. Chiarella:
The U.S. Nuclear Regulatory Commission (NRC; the staff) has completed the enclosed final Supplement 49 to NUREG-1437, Generic Environmental Impact Statement for License Renewal of Nuclear Plants (SEIS), regarding the license renewal of Limerick Generating Station, Units 1 and 2 (Limerick), in accordance with the National Environmental Policy Act of 1969, as amended (NEPA). With this letter, I am forwarding you a copy of the final SEIS, as well as the associated Federal Register notice of availability.
As part of its NEPA review, the NRC considered effects to species and habitats protected under the Endangered Species Act of 1973, as amended (ESA). The NRC determined that continued operation of Limerick during the license renewal term would have no effect on any Federally listed species or critical habitats under the National Marine Fisheries Services (NMFSs) jurisdiction. The NRC forwarded a copy of the draft SEIS, which documented the staffs no effect finding, to NMFS for review in a letter dated May 7, 2013. Subsequently, in a letter dated May 13, 2013, the NMFS confirmed that no ESA section 7 consultation between the NRC and NMFS is necessary for the proposed action. In preparing the final SEIS, the NRC staff did not identify any new information that would change the staffs no effect determination.
The NRC also considered effects to essential fish habitat (EFH) protected under the Magnuson-Stevens Fishery Conservation and Management Act, as amended. The NRC determined that the continued operation of Limerick during the license renewal term would have no effect on six EFH species and would have minimal adverse effects on juvenile and adult bluefish
M. Colligan and (Pomatomus saltatrix), juvenile and adult summer flounder (Paralicthys dentatus), juvenile and adult windowpane flounder (Scopthalmus aquosus), and juvenile and adult winter skate (Leucoraja ocellata). The NRC forwarded its EFH Assessment, which documented these conclusions, to NMFS for review and requested abbreviated EFH consultation in a letter dated July 24, 2014. Subsequently, in an email dated August 13, 2014, the NMFS provided the NRC with one EFH Conservation Recommendation. The NRC responded to this recommendation in a letter to NMFS dated August 27, 2014. This letter concluded EFH Consultation for Limerick license renewal.
I have enclosed a copy of the final SEIS for your records. I look forward to future coordination with your offices to ensure the continued protection of Federally listed species and designated critical habitats at Limerick and other NRC-licensed operating nuclear plants in your region.
