RELIEF FROM ASME CODE, SECTION XI, SERVICE WATER SYSTEM REPAIR - H. B. ROBINSON STEAM ELECTRIC PLANT, UNIT NO. 2, (TAC NO. M82080)

By letter dated September 27, 1991, as supplemented January 29, 1992, jCarolina Power and Light Company (CP&L) requested relief from the requirements of American Society of Mechanical Engineers Boiler and Pressure Vessel Code (ASME Code),Section XI, pursuant to 10 CFR 50.55a(g)(6)(i). The relief for temporary non-code repair of the Service Water (SW) system piping welds related to Containment Fan Cooler HVH-4 and welds at the SW containment penetrations had been previously approved in NRC letter of January 23, 1991, under the condition that a permanent repair of the piping welds in compliance with the ASME code would be performed during the next Refueling Outage (Refueling Outage 14 in 1992).

However, CP&L has subsequently determined that the extensive engineering and construction planning necessary to perform the permanent repairs could not be completed in time to be accomplished during Refueling Outage 14 and now requests continuation of the relief until the permanent repairs are made during Refueling Outage 15 (presently scheduled for late 1993).

In accordance with the requirements of 10 CFR 50.55a, the staff has performed a review of your request. The staff concludes that compliance with the ASME Code requirements would be impractical to perform and that performance of the temporary nontcode repair you proposed would provide an acceptable level of quality and safety. -2 10 CFR 50.55a(a)(3)(i), (a)(3)(iii), or (g)(6)(i), is authorized by law and will not endanger life or property, or the common defense and security and is otherwise in the public interest giving due consideration to the burden upon CP&L that could result if the ASME Code requirements were imposed on the facility.

This relief is granted until the completion of Refueling Outage 15 scheduled for late 1993. The staff's Safety Evaluation on this request is enclosed.
