EXEMPTIONS UNDER 18 U.S.C. 925(d)(3) PERTAINING TO THE IMPORTATION OF FIREARMS - ROBINSON STEAM ELECTRIC PLANT, UNIT NO. 2; BRUNSWICK STEAM ELECTRIC PLANT UNITS 1 AND 2; AND SHEARON HARRIS NUCLEAR POWER PLANT, UNIT I TAC NOS. 80359'AND 80360, 81181, AND 81182)
In your April 17, 1991, letter, subject as above, you requested our assistance in pursuing alternative means of compliance with the provisions of 18 U.S.C.
925(d)(3) to enable you to continue purchasing the Heckler & Koch GMBH model HK93A2 rifle. Under that statute, the rifle is classified as a semiautomatic assault'rifle and-has been denied importation since 1989 by the Bureau of Alcohol, Tobacco, and Firearms (ATF). You expressed concern about the cost involved in changing weapons and requalifying your guards/armed responders with them.
The NRC recently asked the ATF to exempt two nuclear fuel fabrication facilities from the ban on importation of semiautomatic assault rifles and the ATF subsequently advised the NRC that they had no authority to exempt the fuel facilities. I have attached a copy of these letters for your information.
The NRC is not taking any further action at this time due to the availability of domestic rifles and because other power reactor licensees have successfully integrated alternative rifles into their programs as older weapons needed replacement. Some licensees have facilitated familiarization with and use of new rifles by having one individual sight align all rifles. This has also facilitated better use of older rifles.
