(NRC EXAMINATION REPORT NO. 50-261/94-300)
This refers to the Nuclear Regulatory Commission (NRC) administered
examinations led by Ronald F. Aiello during the period of July 11-29, 1994.
The examinations were administered to employees of your company who had
applied for licenses to operate the H. B. Robinson Steam Electric Plant. At
the conclusion of the examination, the examinations and preliminary findings
were discussed with those members of your staff identified in the NRC
Examination Report, Enclosure 2.
Based on the results of this examination, certain of your activities appeared
to be in violation of NRC requirements, as specified in Enclosure 1, Notice of
Violation (Notice). This violation is of concern because the inactive
operator or senior operator may not be fully aware of current plant status if
that operator does not perform a complete tour of the plant under the
direction of an active operator or senior operator, as appropriate, prior to
the reactivation of his or her license.
Your failure to assure that the qualifications and status of reactor operators
are current and valid prior to assumption of licensed functions is similar to
previous NRC findings. Such findings included, (1) adequacy of Emergency
Operating Procedures and their verification and validation, (2) a large
backlog of procedure changes, and (3) assuring the qualifications and status
of reactor operators are current and valid prior to assumption of licensed
functions. Additionally, this report addresses a lack of availability of
breaker operating tools, weak examination results and failure to have required
reading to assure operators are informed. We believe that your failure to
take broad corrective actions to assure that an entire problem area is
corrected, instead of responding to specific deficiencies noted in our past
inspection and examination reports, is the root cause of continuing poor
performance in the areas of operator performance, training and procedural
development and control.
We request that you address these concerns in
addition to your required response to the cited violation within 30 days of
the date of this letter. We additionally invite you to the Region II offices

so you may present your corrective actions to this violation and the related
programmatic weaknesses.
You are required to respond to this letter and should follow the instructions
specified in the enclosed Notice when preparing your response. In your
response, you should document the specific actions taken and any additional
actions you plan to take to prevent recurrence. After reviewing your response
to this Notice, including your proposed corrective actions and the results of
future inspections, the NRC will determine whether further NRC enforcement
action is necessary to ensure compliance with NRC regulatory requirements.
In addition, the enclosed Examination Report identifies activities that
violated NRC requirements that will not be subject to enforcement action
because the licensee's efforts in identifying and/or correcting the violation,
meet the criteria specified in Section VII.B of the Enforcement Policy.
The responses directed by this letter and the enclosed Notice are not subject
to the clearance procedures of the Office of Management and Budget as required
by the Paperwork Reduction Act of 1980, Pub. L. No.96-511.
A copy of the Facility Comments regarding the written examination is included
in this report as Enclosure 3. The NRC Resolution of Facility Comments is
included as Enclosure 4.
A Simulator Facility Report is included in this report as Enclosure 5. A copy
of the written examination questions and answer key, as noted in Enclosure 6,
was provided to members of your training staff at the conclusion of the
examination.
In accordance with 10 CFR 2.790 of the NRC's "Rules of Practice," a copy of
this letter and its enclosures will be placed in the NRC Public Document Room.
