PROPOSED IMPOSITION OF CIVIL PENALTY - $37,500 This is to inform the Commission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $37,500 will be issued on or about March 14, 1994 to the Carolina Power and Light Company. This action is based on violations involving (1) the degradation of both emergency diesel generators due to the mispositioning of their automatic voltage regulator adjustment potentiometers as an inadvertent result of maintenance activities, and (2) the failure of a diesel generator to start during surveillance testing because of inadequate corrective actions for an earlier problem. The resulting violation has been characterized as a Severity Level III problem which has a base civil penalty of $50,000. A civil penalty of $37,500 has been proposed after 25 percent mitigation for the licensee's root cause investigation.
It should be noted that the licensee has not been specifically informed of the enforcement action. The schedule of issuance and notification is:

The licensee has thirty days from the date of the Notice in which to respond.
Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
