PROPOSED IMPOSITION OF CIVIL PENALTY - $37,500 This is to inform the Commission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $37,500 will be issued on or about December 16, 1991 to Carolina Power and Light Company (H. B. Robinson).
This action is based on four examples of inadequate design review for safety related equipment. Three of the examples involved the safety injection pumps and the fourth involved the reactor protection system. Collectively, these examples have been categorized as a single Severity Level III violation. After considering the escalation and mitigation factors, the base civil penalty of
$50,000 has been reduced by 25 percent. Fifty percent mitigation for licensee identification was partially offset by 25 percent escalation for prior notice.
It should be noted that the licensee has not been specifically informed of the enforcement action. The schedule of issuance and notification is:
Mailing of Notice December 16, 1991 Telephone Notification of Licensee December 16, 1991 The State of South Carolina will be notified.
The licensee has thirty days from the date of the Notice in which to respond.
Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
