CONFIRMATORY ACTION LETTER On November 18, 1993, Carolina Power and Light Company (CP&L) management made a decision to place Robinson Unit 2 in cold shutdown because of a concern with an incorrect core reload. This letter confirms the telephone conversation between Mr. W. Orser and me on November 19, 1993. It is our understanding that you agree to complete the specific items identified below prior to the restart of your Robinson Unit 2.

1. Conduct a detailed root cause analysis of the core loading problems including the following:
a. The Siemens inspection tool failure and the resulting fuel assembly relocation.
b. The misconfiguration of fuel assemblies.
c. The adequacy of CP&L's oversight of Siemens activities both onsite refueling and the core Inalysis activities.
2. Meet with the NRC prior to completing the core configuration alterations to provide the results of the root cause analysis of core load deficiencies and the basis for the proposed corrective actions.
3. Determine the cause of the nuclear instrumentation anomalies and implement appropriate corrective actions.
4. Evaluate operator performance and procedures during the aborted startup and complete recommended training/corrective actions.
5. Meet with and obtain the concurrence of the NRC prior to entering the startup mode to review the effectiveness of your root cause analysis, your corrective actions, and your readiness to restart the unit.

Pursuant to Section 182 of the Atomic Energy Act, 42 U.S.C. Section 2232, and 10 CFR 2.204, you are required to:

1) Notify me immediately if your understanding differs from that set forth above,
2) Notify me if for any reason you cannot complete the actions within the specified schedule and advise me in writing of your modified schedule in advance of the change, and
3) Notify me in writing when you have completed the actions addressed in this Confirmatory Action Letter.

Issuance of this Confirmatory Action Letter does not preclude issuance of an order formalizing the above commitments or requiring other actions on the part of the licensee. Nor does it preclude the NRC from taking enforcement action for violations of NRC requirements that may have prompted the issuance of this letter. In addition, failure to take the actions addressed in this Confirma tory Action Letter may result in enforcement action.

The responses directed by this letter are not subject to the clearance procedures of the Office of Management and Budget as required by the Paperwork Reduction Act of 1980, Pub. L. No.96-511.

In accordance with 10 CFR 2.790 of the NRC's "Rules of Practice," a copy of this letter will be placed in the NRC Public Document Room.
