NOTICE OF VIOLATION

(NRC INSPECTION REPORT NO. 50-261/92-17)

This refers to the inspection conducted by E. B. Pharr of this

office on June 1-5, 1992.

The inspection included a review of

activities authorized for your H. B. Robinson facility. At the

conclusion of the inspection, the findings were discussed with

those members of your staff identified in the report.

Areas examined during the inspection are identified in the

report. Within these areas, the inspection consisted of selec

tive examinations of procedures and representative records,

interviews with personnel, and observation of activities in

progress.

Based on the results of this inspection, certain of your activi

ties appeared to be in violation of NRC requirements, as speci

fied in the enclosed Notice of Violation (Notice). The viola

tions are of concern because they appear to indicate a lack of

attention to detail for certain radiation protection activities.

In particular, the failure of Health Physics (HP) supervision to

provide adequate oversight of contractor compliance with site HP

requirements is a concern. The failure of licensee personnel to

properly monitor for contamination is an additional concern since

the issue was also identified during a licensee self-assessment

during May, 1992, but was not resolved satisfactorily to prevent

recurrence.

In addition to the need for corrective action regarding the

specific matters identified in the enclosed Notice, we are

concerned about the implementation of your contractor technician

training program that contributed to development of the situation

as specified in the enclosed Notice. Closely associated with

Violation A is a concern that inadequate training was provided

for the contract Decontamination Supervisor, in that he was not

specifically trained to perform the task, nor in the appropriate

procedure. Consequently, your response should describe those

particular actions taken or planned to improve the effectiveness

of your program.

You are required to respond to this letter and should follow the

instructions specified in the enclosed Notice when preparing your

response.

In your response, you should document the specific

actions taken and any additional actions you plan to prevent

recurrence. After reviewing your response to this Notice,

including your proposed corrective actions and the results of

future inspections, the NRC will determine whether further NRC

enforcement action is necessary to ensure compliance with NRC

regulatory requirements.

In accordance with 10 CFR 2.790 of the NRC's "Rules of Practice,"

a copy of this letter and its enclosures will be placed in the

NRC Public Document Room.

The responses directed by this letter and the enclosed Notice are

not subject to the clearance procedures of the Office of Manage

ment and Budget as required by the Paperwork Reduction Act of

1980, Pub. L. No. 96.511.
