ENCLOSURE 1 NOTICE OF VIOLATION Carolina Power and Light Company Docket No. 50-261 H. B. Robinson License No. DPR-23 During the NRC inspection conducted on May 11 - June 13, 1989, a violation of NRC requirements was identified.

In accordance with "General Statement of Policy and Procedure For NRC Enforcement Actions," 10 CFR Part 2, Appendix C (1988), the violation is listed below:

10 CFR 50, Appendix B Criterion XVI, and the licensee's accepted Quality Assurance (QA)

Program, Updated Final Safety Analysis Report (UFSAR)

Section 17.2.16, collectively require that measures be established to assure that conditions adverse to quality are promptly identified and corrected. Additionally, measures shall assure that the cause of the condition is determined and corrective action taken to preclude recurrence.

Contrary to the above:

1. Measures were inadequate in assuring prompt identification and correction of a Component Cooling System (CCS) leak, in that, from April 30 - June 2, 1989, thirteen water additions were made to the CCS without prompt identification of, nor prompt correction of, a CCS leak.
2. Measures were inadequate in assuring prompt correction of the failure of valve CC-832 to fully close on February 2, 1988, in that, as of June 9, 1989, the condition had not been corrected.
3. Measures were inadequate in assuring prompt corrective action of, and precluding recurrence of, valve TCV-144 failing to stroke properly, in that, from September 7, 1988 - May 31, 1989, this valve failed to stroke within its required time on three occasions.

This is a Severity Level IV Violation (Supplement I)

Pursuant to the provisions of 10 CFR 2.201, Carolina Power and Light Company is hereby required to submit a written statement or explanation to the Nuclear Regulatory Commission, ATTN:

Document Control Desk, Washington, DC 20555, with a copy to the Regional Administrator, Region II, and a copy to the NRC Resident Inspector, within 30 days of the date of the letter transmitting this Notice.

This reply should be clearly marked as a "Reply to a Notice of Violation" and should,include: (1) admission or denial of the violation, (2) the reason for 8907180381 890707 PDR ADOCK 05000261 0

License No. DPR-23 the violation if admitted, (3) the corrective steps which have been taken and the results achieved, (4) the corrective steps which will be taken to avoid further violations, and (5) the date when full compliance will be achieved.

Where good cause is shown, consideration will be given to extending the response time. If an adequate reply is not received within the time specified in this Notice, an order may be issued to show cause why the license should not be modified, suspended, or revoked or why such other action as may be proper should not be taken.
