Gentlemen:
By Order of July 17, 1978, the Appeal Board assigned to this proceeding deferred its sua sponte review of the Partial Initial Decision (PID).on environmental matters issued on June 16, 1978 "until the rendition of the Licensing Board's final decision in the proceeding". On June 26, 1979 the Licensing Board issued an "Order Granting Applicant's Motion to Terminate Proceeding". Since it appears that the Appeal Board was not served with that Order, copies are enclosed for your review. This Order constitutes the Licensing Board's !final decision in the proceeding" and, therefore, removes the reason for the Appeal Board's deferral of its review of the PID. For your information the requested amendment was issued on June 29, 1979.
