Limerick AAM (MN No.14-006) - ACE Waste Confidence & License Renewal Question Dr. Cuthbert (ACE),

At the public Annual Assessment Meeting for Limerick on May 7, 2014, you asked whether the Limerick license could be renewed before the waste confidence issue is resolved. At that meeting, I committed to respond to you on that question. After discussing this issue with the Environmental Project Manager for the Limerick license renewal project, we are providing you with the following response to your question. If you have further questions on this issue or regarding the renewal of the Limerick license, please contact the Environmental Project Manager, Leslie Perkins, using the contact information below.

The response to your question is that the Commission has ordered that the NRC will not make a decision regarding the renewal of Limericks license until the waste confidence final rule is complete. Specifically, in a memorandum and order (CLI-12-16), the Commission directed that the staff would not issue licenses dependent upon the waste confidence rule, until issues identified US Court of Appeals for District of Columbia decision are addressed. CLI-12-16 can be accessed on the NRC website at http://www.nrc.gov/reading-rm/doc-collections/commission/orders/2012/2012-16cli.pdf.

The Commissions direction is also documented in Chapter 6 of the Limerick Draft Supplemental Environmental Impact Statement (DSEIS) that was issued in April 2013. As documented in the slide presentation (ML13141A188, slide 13), the NRC staff addressed this question in a public meeting that was held in Pottstown, Pennsylvania on May 23, 2013. The purpose of this public meeting was to discuss the staffs preliminary findings in the DSEIS (ML13120A078). The list of meeting attendees, Enclosure 1 to the meeting summary (ML13156A090), indicates that you were a participant in this meeting. However, if you have additional questions regarding the conduct of the May 23, 2013 meeting, the transcripts (ML13172A019 and ML13172A023) are publicly available in ADAMS.
