REQUEST FOR WITHHOLDING INFORMATION FROMl PUbLIC DISCLUSURE (SAN ONOFRE NUCLEAR GENERATING STATION, UNITS 2 AND 3)
A letter from Southern California Edison Company, dated Septeiacer 3, 1980, transmitted "CPC/CEAC Software fModifications for San Onofre Unit 2 (Response to NRC Question 221.18)," CEN-135(S)-P and requested that it be withheld from public disclosure pursuant to 10 CFR 2.790. Your affidavit and a non-proprietary version of CEN-135(S)-P were also transmitted by the September 3, 1980 letter.
Your reasons for requesting our withholding of this information were (1) the information has been held in confidence by Combustion Engineering and is not publicly available, (2) application of the data provides Combustion Engineeringywith a substantial coipetitive advantage, and (3) public disclosure of the information would cause substantial harm to the competitive position of Combustion Engineering.
We have reviewed your affidavit and materid1 based on the requirements and criteria of 10 CFR 2.790 and have determiined that the above-mentioned document sought to be withheld contains trade secrets or confidential or proprietary coamercial or financial informration.
We also have found at this time that the right of the public to be fully apprised as to the bases for and effects of the proposed action does not outweigh the demonstrated concern for protection of your competitive position. Accordingly, we have determined that the information should be withheld from public disclosure.
We therefore approve your request for withholding pursuant to Section 2.790 of 10 CFR Part 2 and are withholding CEN-135(S)-P from public inspection as pra i tary.
810 114 Withholding from public inspection shall not affect the right, if any, of persons properly and directly concerned to inspect the documents.
If the need arises, we may send copies of this information to our consultants working in this area. We will, of course, assure that the consultants have signed the appropriate agreements for handliny proprietary data.
