SUMMARY
OF APRIL 9, 2014, PRE-SUBMITTAL MEETING WITH DUKE ENERGY PROGRESS, INC. ON PROPOSED TECHNICAL SPECIFICATION AMENDEMENT REQUEST On April 9, 2014, a Category 1 public meeting was held between the U.S. Nuclear Regulatory Commission (NRC) staff and representatives of the licensee, Duke Energy Progress, Inc. (DEP) by telephone.
The purpose of the meeting was for the licensee to present its approach to change Technical Specification (TS) related to lead test assemblies (L TAs) fuel for spring 2015 installation.
An agenda was provided with the meeting notice (ADAMS Accession No. ML14087A080). A list of attendees is enclosed.
Representatives from DEP described two independent planned actions in their presentation (ADAMS Accession No. ML14098A335). The first involved the use of L TAs in the upcoming cycle, and the second is a planned license amendment request to revise Technical Specification 5.3.1 Design Features-Fuel Assemblies.
DEP intends to load eight AREVA GAIA [Generation of Advanced Innovative Assembly] LTAs in nonlimiting locations in the spring 2015 refueling outage. Each of the assemblies is expected to be exposed for three operating cycles. Details of the GAIA design were discussed in a meeting on June 14, 2013, between AREVA and the NRC staff (ADAMS Accession No. ML13163A406).
AREVA plans to send a report to the NRC for information only summarizing this LTA project.
Details of the design and testing will be available at either DEP or AREVA if an audit is requested by NRC staff. DEP stated that they believe the L TA loading program can be performed within the context of the current TS and the under the provision in Title 1 0 of Code of Federal Regulations (1 0 CFR), Section 50.59, Changes, tests and experiments.
The second topic discussed was a proposed change to the Shearon Harris TS 5.3.1, Design Features-Fuel Assemblies, to conform to NUREG 1431, Standard Technical Specifications-Westinghouse Plants. The change is not related to the LTA project previously discussed. DEP intends to revise portions of the TS to the corresponding specification in NUREG 1431, resulting in removal of the level of detail below that required by 10 CFR 50.36. DEP described the change as administrative in nature. Subsequent discussion clarified that the DEP would document the justification for the change in the license amendment request (LAR), since conformance with NUREG-1431 alone is not sufficient justification.
In summary, the DEP confirmed that the LAR and L TA discussions were independent topics.
and the upcoming LAR to change the TS would not reference the L TA program.
No regulatory decisions were made at the meeting. Members of the public were not in attendance. No Public Meeting Feedback forms were received.
