Dear Sir or Madam:

Order EA-13-092 (Reference 1) defined the interim class of NRC-licensed facilities that are eligible to apply to the Commission for authorization to use preemption authority under Section 161A of the Atomic Energy Act of 1954, as amended (42 USC 2201 a),

and the process to be used for such application.

San Onofre Nuclear Generating Station (SONGS), Dockets Nos. 50-361, 50-362, and 72-41, is within the interim class of facilities designated by the Commission as listed in of Reference 1. By letter dated August 28, 2013 (Reference 2) SCE applied pursuant to 10 CFR 59.90 for Commission authorization to use Section 161 Preemption Authority under 42 USC 2201a.

This letter is to notify the NRC that, on December 9, 2013, SCE determined a sufficient number of personnel have successfully completed the requisite firearms background check such that SONGS security organization can be staffed as specified in the P.O. approved SONGS Security Plan. SCE also determined that the SONGS security organization can be staffed so that the protective strategy and procedures can be effectively implemented, while meeting applicable fatigue requirements in 10 CFR Part 26, "Fitness for Duty Programs".

The language in order EA-1 3-092 implied that this notification was to be transmitted to the NRC by December 22, 2013. SCE did confirm the required background checks were completed by December 09, 2013; however, it was not recognized at that time that December 22, 2013 was the expected written notification date.

There are no new regulatory commitments in this letter.
