PROCEEDINGS CHAIRMAN MACFARLANE: Okay please go ahead.
KEN HART: The first item for Affirmation is SECY-13-0085 - Southern California Edison Co. (San Onofre Nuclear Generating Station, Units 2 and 3), NRC staffs motion to vacate the Licensing Boards full initial decision, LBP-13-7. The Commission is being asked to act on a Memorandum and Order responding to a motion by the NRC staff that the Licensing Boards order in this matter, LBP-13-7, be vacated. The Commission, with Chairman Macfarlane concurring in part, dissenting in part, and offering additional views, has voted to approve a Memorandum and Order which vacates as moot LBP-13-7 and terminates this proceeding.

KEN HART: The second item today is SECY-13-0035A - Southern California Edison Companys Motion to Withdraw License Amendment Request and to Vacate LBP-12-25 and Associated Petition for Review as Moot. NRC Staffs Motion to Vacate Licensing Board Order LBP-12-25. The Commission is being asked to act on a Memorandum and Order responding to Southern California Edison Companys motion to withdraw its license amendment request associated with relocating certain surveillance frequencies from San Onofre Nuclear Generating Stations technical specifications, as well as Edisons and the NRC Staffs motions to vacate LBP-12-25 and dismiss Citizens Oversights petition for review as moot.
The Commission has voted to approve a Memorandum and Order which grants the motion to withdraw, dismisses as moot the Citizens Oversights appeal and vacates the boards decision
4 in LBP-12-25. Chairman Macfarlane would you please affirm your vote.
