Docket Nos. 50-206, 50-361 and 50-362 San Onofre Nuclear Generating Station Units 1, 2 and 3 The NRC's letter dated December 6, 1985 reviewed fees for applications filed by SCE prior to June 20, 1984 which are subject to the March 23, 1978 10CFRI70 fee requirements.
Your review concluded that a sum of $10,100 is due the NRC.
SCE has reviewed the enclosure to your letter and disagrees with the fee determinations made for Items 4b, 4c, 9a, and 11.
Item 4B assesses a Class III $4,000 fee for Proposed Change No. NPF-10-56. This proposed change is similar to Proposed Change No. NPF-10-51 which was assessed a Class II fee of $1,200, in that it minimized differences between Units 2 and 3 technical specifications.
The proposed change corrects an error which existed in the standard technical specifications that was recognized in the period between issuance of the Units 2 and 3 technical specifications.
SCE considers that no safety issue was involved with this change and that it is administrative in nature. Therefore, a Class II, $1,200 fee is appropriate for this application.
Item 4c assesses a Class III fee of $4,000 for Proposed Change No. NPF-10-59.
Proposed Change No. NPF-10-59 provided special test exceptions required to perform natural circulation testing mandated by the NRC during the OL review. The NRC's evaluation of and requirement for natural circulation testing for SONGS 2 is discussed in Section 5.1 of NUREG-0712, "Safety Evaluation Report (SER) related to the operation of SONGS 2 and 3."
SCE considers that any safety significance associated with the performance of natural circulation tests were evaluated when the original requirement was mandated. Therefore, the proposed change is administrative in nature in that it merely allows NRC requirements to be accomplished. SCE considers that a Class II fee of $1,200 is appropriate for this application.

-2 Item 9a assesses a Class III and a Class I fee ($4,400) for Proposed Change No. NPF-10/15-79. Proposed Change No.
NPF-10/15-79 resolved an existing discrepancy in the administrative section of the technical specifications regarding the review responsibility for changes to the Offsite Dose Calculation Manual, Process Control Program, and major changes to the radwaste treatment systems. The SER issued with Amendment Nos. 25 and 14, which approved this proposed change, concluded that the proposed change corrects existing errors in the technical specifications.
The proposed change is therefore administrative in nature and a Class II fee of $1200 and a Class I fee of $400 is appropriate for this application.
Item 11 assesses a Class III and Class I fee ($4,400) for Proposed Change No. NPF-10/15-98. This Proposed Change would no longer require prompt reports for deviations from the approved Fire Protection Program under License Condition 2G, which are otherwise reportable. SCE considers a change in reporting requirements to be an administrative change. The safety significance of a change in the mechanism for making a report is unclear. Therefore, SCE considers that a Class II fee of $1,200 and a Class I fee of $400 is appropriate for this application.
Your December 6 letter assessed a total of $16,800 in fees (four Class III and two Class I) for Items 4b, 4c, 9a, and
- 11.
SCE considers that four Class II, and 2 Class I fees are appropriate for these applications ($5,600).
The difference between your fee determination for these four items and SCE's determination is $11,200 which exceeds the $10,100 requested by your letter by $1,100.
SCE requests that you review your fee determinations for the above noted items and apply the $1,100 excess in SCE's favor to future billings.
