AMENDMENT APPLICATION NO. 212, REQUEST FOR EXTENSION OF OPERATING LICENSE EXPIRATION DATE, SAN ONOFRE NUCLEAR GENERATING STATION - UNIT 1 (TAC NO. M90325)

Dear Mr. Ray:

This letter provides the NRC response to your Amendment Application No. 212, dated September 6, 1994, requesting an extension to the expiration date for the San Onofre Nuclear Generating Station (SONGS), Unit 1 Operating (Possession Only) License, DRP-13.

The regulatory requirements for renewal of an operating license for a permanently shut down nuclear power facility have been updated since the submittal of your September 6, 1994, request. Specifically, 10 CFR 50.51(b) states that the license continues in effect beyond the expiration date for a facility that has permanently ceased operations to authorize ownership and possession of the facility until the Commission notifies the licensee in writing that the license is terminated. Therefore, DRP-13 will remain in effect and no specific action is needed to obtain an extension to the expiration date.

Under the current provisions of 10 CFR 50.82(a)(3), decommissioning is to be completed within 60 years of permanent cessation of operations. Therefore, your decommissioning schedule will determine the expiration date for DRP-13.
