CLOSURE OF SAN ONOFRE NUCLEAR GENERATING STATION UNIT 1 Thank you for keeping us informed of the ongoing California Public Utility Commission's proceedings that may affect the future operations at San Onofre Nuclear Generating Station, Unit 1. Based on.your correspondence and our discussions with your staff, it appears that a permanent closure of Unit 1 is likely to occur later this year or In mid-1993. If plant closure proceeds as projected, the NRC staff is prepared to respond to related licensing issues to close the plant safely, in compliance with Federal regulations applicable to nuclear plant closure and decommissioning.

We have evaluated existing issues related to the proposed closure of Unit 1 and have the following observations. Your letter dated January 15, 1992, proposed to extend the existing Unit 1 reactor fuel cycle by performing a "mid-cycle fuel shuffle". You propose to exchange fuel from the reactor with partially expended fuel in the spent fuel pool.

You state this process would extend the current operating cycle by approximately 6 months. This proposed fuel exchange appears to include all the operations and related safety concerns associated with a reactor refueling. The proposed fuel exchange would be performed at the approximate time identified as the cycle 12 refueling outage by the Confirmatory Order that was issued to the Southern California Edison Company on January 2, 1990. In terms of regulatory requirements, we view the "mid-cycle fuel shuffle" as a reactor refueling that would trigger the requirement to perform the cycle 12 projects as identified by our Confirmatory Order.

We recognize that you desire to operate through the peak electrical load demands during the summer of 1993 before permanently closing the reactor.

However, to do so, you need to either comply with the requirements of the January 2, 1990, Confirmatory Order or evaluate the safety consequences of extending reactor operations without upgrading the plant. If your evaluation concludes that extended operations can continue yet provide reasonable assurance to the protection of the public health and safety, you may seek a license amendment which would modify the conditions of the Confirmatory Order.
