SUMMARY

OF MEETING TO DISCUSS FEDERAL COASTAL ZONE MANAGEMENT ACT On Friday, November 13, 1981, a meeting was held in Washington, D.C. to discuss the Federal Coastal Zone Management ct (CZMA) as it related to issuance of operating licenses to SONGS 2 and 3. In attendance at the meeting were representatives of the National Oceanographic and Atmospheric Administration (NOAA), the Nuclear R~gulatory Commission (NRC) staff, the California Coastal Commission staff, and the Southern California Edison Company (SCE). The attendees list is given in Enclosure 1.

The topics discussed at the meeting included; (1) the question of whether or not issuance of an operating license (OL) for SONGS 2, limited to operation at less than 5% of full power, would constitute a "listed Federal license activity", under the CZMA and NOAA regulations at 15 CFR 930.54; (2) whether or not the issuance of a low power operatirg license to SONGS 2 is subject to the consistency provisions of the CZMA, in light of the fact that the appli cation for operating licenses for SONGS 2 and 3 was filed with the NRC prior to approval of the California Coastal Management Program by the Secretary of Commerce; (3) some of the details of construction status of SONGS; and (4) whether or not the physical features and administrative controls currently proposed by SCE to control access to the beach within the exclusion area were incorporated in the original SONGS 2 and 3 OL application docketed on March 23, 1977.

At the November 13, 1981 meeting, the NRC staff stated that it believed that the low power OL for SONGS 2 was a "listed" activity, but that the prohibi tions and requirements of the CZMA only apply to applications filed after final approval by the Secretary of Commerce of the California Coastal Management Program, which occurred on November 7, 1977. In the NRC staff's view, the issuance of an operating license limited to operation at power levels not to exceed 5% of full power, does not constitute a new or different activity, and is not a major amendment of the activity for which authorization OFFICE8 e................................

Such partial authorizations are routinely issued by the NRC staff in cases where an OL applicant has satisfied all the requirements for low power operations, but has not yet satisfied certain requirements which apply only to operation at high power levels.
