Parties to the Agreement:

The bases for this Memorandum of Agreement are the results of Applicants' studies of the Ethnigraphy, Arenaeclogy, and History of the vicinity of the Applicants' transmis sion lines associated with the Zan Onofre nuclear Generat ing Station, Units 2 and 3. These cultural resources studies were conducted in compliance with the National.
Historic Preservation Act and the National E-vircrmental Policy Act fdr the licensing of' San Onofre Juclear Genera tion Station, Units 2 and 3, and fulfillmnt of The terms of this Memorandum of Agreement will constitute full compliance thereof.

For purposes of this Memorandum of Agreement.
the "area of potential environmental impact" shall be defined as tre "right of way" as purchrased, leased, or otherwise encum bered for development and maintenance of the transmi.ssicn lines associated with Units 2 and 3 of the San Onofre Nuclear Generating Station.

Those sites listed under points (3) and (5) above will be documented by the applicants to determine their eliibil ity.
For those sites listed under point (3), this docu mentation will consist of micromapping. For those sites listing under point (5), documentation will conform to 36 CFR Part 63 and consist of at least an understanding of the surface and subsurface comoonents of the sites and firm boundary and locationa. determinations.
All sites will be entered into the California Archaeological Survey and will be referred to by their appropriate State Trinomial Numbers.
- 7.
To facilitate the processing of this document and maximize benefit of this effort, the following points should be followed:
- a.
The applicants shall, on behalf of Contractor, obtain permission for Contractor to enter upon and make all necessary tests and examinations required under the terms of this Agreement for all properties located within "rights of ways." For sites partially located within "right-of-way73" applicants shall attemDt to obtain permission to perform such work on the entire site.
This stipulation is subject to existing legal constraints.
- b.
Principal Investigators shall meet the.3pecfications In 36 CFR S6 (proposed).
- a.
A research design will be developed to incorporate those researon questions whi on can be addressed with out increase in costs ceyond that wnicn is necessary for adequately documenting site eligibility for listing on the National Register of Historic Places.
- d.
The scope of work and research design will be devel oped in consultation with the local Native Americans' representative(s) designated by the California Native American Heritage Commission.
- e.
Within 10 working days of receipt of the research design, the office of Historic Preservation snail comment to the Nuclear Regulatory Commission regard ing the acceptability of the researcn design.
- f.
The scope of work shall designate the specific dis position of all artifactual materials recoverea during this program in accordance with the following points:
- 1)
Cultural materials will be curated in accordance with the desires of the local Native Americans (as defined in 7.d.) and current professional standards, except as noted in paragraph 7.f.3 below.
- 2)
Human remains and objects determined to be sacred to Native Americans. if discovered. shall be treated in accordance with plans aevelopea in consultation with local Native Americans (7.d.).
- 3)
If the property owner is other than the appli cants and refuses to relinquish possession of the materials, these materials will be fully analyzed and documented prior to being returned to the owner.
- g.
The Cultural Resource Report shall deal with the specifics of properties, their eligibility, current and future effects, and possible mitigating actions where appropriate.
- h.
Applicant will disseminate the report to the con cerned Native American groups (7.d.), concerned academic communities and the governmental
organizations who.ave regulatory or management concerns in the zeneral area of thi3 project.
The Archaeological Report without technical appencices shall be made available to the general puolic.
- i.
The scope of work shall discuss the extent of local Native American involvement in this program, includ ing the process of analysis ana report preparation.
J.
The scope of work and research design shall be guided by Attachment A, ?rofessional Standards for Data Recovery ?rograms.
The applicants 3hall forward these reports to the Nuclear Regulatory Commission and the State Office of Historic Preservation along with a proposed management plan by August of 1980.
This management plan shall consist of the following elements:
- a.
The applicants' assessment of current and future impacts to the sites.
- b.
The applicants' proposed mitigating measures to reduce or eliminate those impact3.
The Management Plan resulting from the evaluation process defined in this Memorandum of Agreement is to be developed in accordance with the following general principles:
- a.
The sole category of impacts to be addressed are those identified as potentially occurring due to operation and maintenance of the subject transmission lines (including Applicant usage of access rcads for maintenance purposes).
- b.
All resource management activitie3 siall be confined to transmission line rights of,.ay and associated transmission line access roaas.
- c.
Mitigation measures.are to be predicated upon the expectably minimal impacts resulting from operation and maintenance of the subject transmission lines.
- d.
Mitigation measures are to be focused on resource preservation rather than data recovery.
- e.
Mitigation measures should balance considerations of cost with resource protection benefits.
- f.
Mitigaticn measures mav include surface collection of imperiled resources.
- g.
Mitigation measures may include rerouting, abandon ment, or stabilization of access roads wh-en feasible, if an eligible property is theraoy protected from significant adverse effect.
- h.
Mitigation measures may include the stabilization of areas subject to erosion as a result of transmission line maintenance. if an eligible property is thereby protected from significanz adverse effect.
I.
The Management Plan shall address the too of disposition of cultural materials collected during mitigation work.
- 10.
Within 30 working days of receipt of this material.
the Office of Historic Preservation 3hall comment to the Nuclear Regulatory Commission concerning eligibility,
.effects, and mitigation.
- 11.
Should the NEC concur with the Office of Historic Preser
- vation, it shall seek determinations of elisilibity from the Keeper of the Register and shall recuire the appli cants to implement the proposed management progra=.
- 12.
Should the NRC disagree with the position of the California Office of Historic Preservation, it shall seek determinations of eligibilitv on the appropriate sites and shall request the Advisory Council's comments.
