Barry and Joey, By letter dated August 19, 2013 (Agencywide Documents Access and Management System (ADAMS)

Accession No. ML13239A072), Entergy Operations, Inc. (Entergy, the licensee) submitted relief request RBS-R&R-2013-001 for the River Bend Station, Unit 1 (RBS). This request for relief proposes an alternative to the postweld heat treatment exemption of Table ND-4622.7 that would provide an acceptable level of quality and safety This relief is requested for the RBS Third 10-year interval of the Inservice Inspection Program commencing on May 31, 2008 and ending December 2017. On October 7, 2013, the U.S. Nuclear Regulatory Commission (NRC) staff issued a letter finding that the proposed request for relief was unacceptable but gave Entergy an opportunity to supplement. By letter dated October 17, 2013 (ADAMS Accession No. ML ML13295A421), Entergy provided a supplement to this request for relief. The purpose of this letter is to provide the results of the NRC) staffs acceptance review of this request for relief.

The regulation at Title 10 of the Code of Federal Regulations (10 CFR) Section 50.55a(a)(3) states that alternatives to the requirements of paragraph (g) may be used, when authorized by the NRC, if the licensee demonstrates that (i) the proposed alternatives would provide an acceptable level of quality and safety or (ii) compliance with the specified requirements would result in hardship or unusual difficulty without a compensating increase in the level of quality and safety. Entergy had originally asked for this request for relief pursuant to Section 50.55a(a)(3)(i) but in its October 17, 2013, letter revised this request to Section 50.55a(a)(3)(ii) .

The NRC staff has reviewed your application and the supplement and concluded that it does provide technical information in sufficient detail to enable the NRC staff to proceed with its detailed technical review and make an independent assessment regarding the acceptability of the proposed requests for relief in terms of regulatory requirements and the protection of public health and safety and the environment. If additional information is needed for the staff to complete its technical review, you will be advised by separate correspondence.
