Dockets Nos. 50-206,.50-361 and 50-362 Licensing Amendment Fees San Onofre Nuclear Generating Station Units 1, 2 and 3 The Safeguards Contingency Plan and Security Force Training and Qualification Plan for San Onofre Units 1, 2 and 3 were submitted by letters dated March 23, 1979 and August 23, 1979, respectively. In accordance with 10CFR170, we determined that each Plan was a Class I licensing amendment and.

remitted the corresponding fee of $800.00 ($400 for each Plan).

By letter dated November 20, 1979, you indicated that you had determined each Plan to be a Class III licensing amendment and provided your basis therefore rather than the Class I licensing amendment as previously determined by our March 23, 1979 and August 23, 1979 letters. Consequently, you requested that we remit an additional $3600.00 for each Plan (a total additional fee of $7200.00) corresponding to the appropriate Class III licensing amendment fee of $4000.00. During telephone discussions with Ms. Reba Diggs of your staff on January 18, 1980 and January 21, 1980, we indicated that your November 20, 1979 letter had been incorrectly filed and that no action had yet been taken on your letter. However, we indicated our intentions to provide a response to your November 20, 1979 letter by January 25, 1980.

Accordingly, we have reviewed your November 20, 1979 letter. Based on your statement that initial NRC staff review time of our Plans is required for San Onofre Unit 1 and the time is not charged to the operating license review costs for San Onofre Units 2 and 3, we concur with your determination and remit herewith the additional licensing amendment fee of $7200.00.

This additional fee combined with our previous fee of $800.00 brings our payment to the Class III fee level of $4000.00 as.required by 10CFR170.22 for each Plan's review and approval.
