Dockets Nos. 50-206, 50-361 and 50-362 lt License Amendment Fee San Onofre Nuclear Generating Station Units 1, 2 and 3 By letter dated March 23, 1979, we.submitted the Safeguards Contingency Plan for San Onofre Units 1, 2 and 3. The Plan was submitted to the NRC for review and approval as required by 10 CFR 50.34 (d) for San Onofre Units 2 and 3 and 10 CFR 73.40 (b) for San Onofre Unit 1. How ever, the appropriate approval/amendment fee as required by 10 CFR 170.22 for San Onofre Unit 1 was inadvertently omitted from our March 23, 1979 submittal.
The requirement to remit such a fee was discussed at NRC Regional meetings held to review the NRC's regulations on Safeguards Con tingency Plans.
By letter dated July 3, 1979, you noted the omission of the approval/amendment fee and requested that we promptly forward to your office the fee of $4,000.00. This request was based on your determination, following a preliminary review, that the Plan is a Class III approval/amendment request relative to San Onofre Unit 1 requiring the remittance of a fee of $4,000.00.
You also noted that any costs relative to review of the Plan for San Onofre Units 2 and 3 will be included as part of the operating license review costs.
The purpose of this letter is to advise you that following receipt of your July 3, 1979 letter, we carefully examined the requirements of 10 CFR Part 170 (Fees for Facilities and Materials Licenses and Other Regulatory Services.

As a result of the examination, we have determined that our Plan is a Class I, rather than a Class III, approval/amendment request relative to San Onofre Unit 1. The basis for this determination is as follows:
- 1. The operating license review costs applicable to 7908290
Ms. Reba August 22, 1979 San Onofre Units 2 and 3 will include the costs associated with review of the Plan, and
- 2. *Any action taken by the NRC (i.e., approval, request for additional information, etc.) applicable to San Onofre Units 2 and 3 will require duplicate actions for San Onofre Unit 1.
Accordingly, remitted herewith is Southern California Edison Company's Check No. T010272 dated May 18, 1979 in the amount of $400.00 as required by 10 CFR 170.22. The fee corresponds to the Class I approval/
amendment determination discussed above.
