MASSACHUSETTS INSTITUTE OF TECHNOLOGY ANNUAL SELF-GUARANTEE TO PROVIDE FINANCIAL ASSURANCE FOR THE MASSACHUSETTS INSTITUTE OF TECHNOLOGY RESEARCH REACTOR

Dear Mr. Ruiz:

By letter dated October 31, 2012, the Massachusetts Institute of Technology (MIT) submitted a self-guarantee agreement and corroborating documentation with respect to providing financial assurance using the self-guarantee method as allowed by Title 10 of the Code of Federal Regulations (10 CFR) Section 50.75(e)(1)(iii) for nonprofit entities, such as universities. MIT is currently providing financial assurance for decommissioning for the Massachusetts Institute of Technology Research Reactor, License No. R-37.

The U.S. Nuclear Regulatory Commission (NRC) staff reviewed the self-guarantee agreement and corroborating documentation to cover the cost of decommissioning the above-mentioned NRC License. The staff evaluated the Annual Self-Guarantee test in accordance with regulations and guidance in effect as of the date of the incoming letter, October 31, 2012 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML12312A475). The staff found that the self-guarantee agreement meets or exceeds the financial test criteria for a nonprofit university that issues bonds, that it is acceptable for providing decommissioning funding assurance, and is in accordance with the provisions of Appendix E to 10 CFR Part 30, Criteria Relating to Use of Financial Tests and Self-Guarantee for Providing Reasonable Assurance of Funds for Decommissioning by Nonprofit Colleges, Universities, and Hospitals. The agreement is in compliance with 10 CFR 50.75(e)(1)(iii) and Appendix E to 10 CFR Part 30; therefore, the licensee submittal is satisfactory.

It should be noted that the incoming letter referenced two NRC licenses held by MIT: License No. 37 and Special Nuclear Materials (SNM) License No. 986. The NRC staff provided a separate response, dated June 13, 2013 (ADAMS Accession No. ML13162A435), related to review of the Annual Self-Guarantee as it applies to SNM License No. 986.
