1. Nuclear Regulatory Commission (NRC) letter from Michele Evans to Preston Gillespie (Duke Energy), "Oconee Nuclear Station, Units 1, 2, and 3 -

Modifications to Address External Flooding Hazards", (TAC Nos. ME7970, ME7971, and ME7972) dated September 20, 2012.

In the staff letter dated September 20, 2012 (Reference 1), the NRC found it acceptable that the structures Duke Energy proposed to mitigate external floods would be designed and constructed in accordance with Federal Energy Regulatory Commission (FERC) accepted codes and standards. The NRC also required Duke Energy to submit their designs for external flood mitigating structures to FERC for their review against the applicable FERC standards.

FERC has indicated that they need a written request from the NRC in order to perform this work. As such, Duke Energy is asking the NRC to provide FERC a letter requesting these reviews be performed. Duke Energy anticipates requesting FERC to perform its first design review by September 26, 2013.
