August 6, 2013 EN 13-028 OFFICE OF ENFORCEMENT NOTIFICATION OF SIGNIFICANT ENFORCEMENT ACTION Licensee: NextEra Energy Point Beach, LLC EA-13-125 Point Beach Nuclear Plant, Units 1 and 2 Docket Nos.: 50-266; 50-301

ISSUANCE OF FINAL SIGNIFICANCE DETERMINATION AND NOTICE OF VIOLATION This is to inform the Commission that a Notice of Violation will be issued on or about August 9, 2013, to NextEra Energy Point Beach, LLC (NextEra) for a violation associated with a White Significance Determination Process finding identified during an inspection of the Point Beach Nuclear Plant, Units 1 and 2. This White finding, an issue of low to moderate safety significance, will require additional U.S. Nuclear Regulatory Commission (NRC) inspections. It involves the failure of Point Beach personnel to implement external flooding wave run-up protection design features as described in the Final Safety Analysis Report (FSAR).

Specifically, Point Beach Nuclear Plant (PBNP) Procedure PC 80 Part 7, as implemented, would not protect safety-related equipment in the turbine building or pump house because the procedure: (1) did not appropriately prescribe the installation of barriers such that gaps between the barriers were eliminated to prevent water intrusion, (2) from 1996 to 2008, did not protect equipment by requiring barriers to be placed in front of the doors as described in the FSAR, and (3) did not require the barriers to protect the plant to an elevation of at least 9 feet as described in the FSAR.

A Notice of Violation is included based on NextEras failure to meet 10 CFR Part 50, Appendix B, Criterion V, Instructions, Procedures, and Drawings, which requires, in part, that activities affecting quality be prescribed by documented instructions, procedures, or drawings of a type appropriate to the circumstances. In accordance with the NRC Enforcement Policy, the NOV is considered an escalated enforcement action because it is associated with a White finding.

NextEra attended a Regulatory Conference on July 22, 2013, and presented its assessment of the significance of the finding. After reviewing the information developed during the inspection, and the information provided by NextEra, the staff revised its preliminary Yellow determination and concluded that the finding is appropriately characterized as White.

It should be noted that the licensee has not been specifically informed of the enforcement action. The schedule of issuance and notification is:
