In December 2006, NRC sent us a request for concurrence with a "not likely to adversely affect" determination (just like you recently did for Seabrook) -- the consultation was never finished. I'm not sure exactly what happened -- I went on maternity leave in mid 2007 and I am thinking that may have had something to do with it.

From what I can gather from my notes that are in the project file, we seemed to have some questions regarding the EPA NPDES permit vs. the NRC license and trying to understand what the status of the NPDES permit was etc. I don't see anything that was raising major red flags from a biology/species impact standpoint.

As you may have heard, we listed Atlantic sturgeon on February 6. They can occur in coastal Massachusetts waters so if we move forward with finishing the consultation we will need to consider Atlantic sturgeon -- I skimmed through the Pilgrim EIS and it doesn't look like there is any record of impingement or entrainment of Atlantic sturgeon so that is good.

Julie--We tracked down the record in your PCTS system, which said that NMFS had closed out the Pilgrim consultation with a letter on March 1, 2007. However, we can't find a record of that letter in our online record system. Do you happen to have a copy of that letter that you could forward to us? I think this would resolve the outstanding question that Jones River Water Association raised about the consultation.

What would be the appropriate response to this? Should we say we just received it and will need to review it, or is there more detail that can be offered at this point?
