MAINE YANKEE ATOMIC POWER COMPANY - CORRECTION TO ISSUANCE OF AMENDMENT TO OPERATING LICENSE NO. DPR-36 REGARDING THE PHYSICAL SECURITY PLAN (TAC NO. L24716)

Dear Mr. Connell:

On May 8, 2013 (ADAMS Accession No. ML13136A201), the U.S. Nuclear Regulatory Commission (NRC) has issued an amendment to Facility Operating License No. DPR-36 for the Maine Yankee Atomic Power Station (MY). The amendment was incorrectly issued as No. 165 instead of No. 173 due to an administrative oversight. The NRC is re-issuing the enclosed amendment as Amendment No. 173 to DPR-36. The amendment consists of changes to the Operating License (OL) in response to your application dated January 3, 2013.

The amendment changes the name of the title of the Physical Security Plan in the Maine Yankee Atomic Power Station Amended Facility OL, License Condition 2.B(6)(d), Physical Protection, from the Maine Yankee Nuclear Power Station Physical Security Plan, which includes the Contingency Plan and the Guard Training and Qualification Plan, to the Maine Yankee Independent Spent Fuel Storage Installation Physical Security Plan.

A copy of our safety evaluation report is also enclosed. The Notice of Issuance will be published in the Federal Register.

SAFETY EVALUATION REPORT BY THE OFFICE OF NUCLEAR MATERIAL SAFETY AND SAFEGUARDS FOR AMENDMENT NO. 173 TO FACILITY OPERATING LICENSE NO. DPR-36 MAINE YANKEE ATOMIC POWER COMPANY MAINE YANKEE ATOMIC POWER STATION DOCKET NOS. 50-309 AND 72-30

1.0 INTRODUCTION

By application dated January 2, 2012 (Agencywide Document and Access Management System (ADAMS) Accession No. ML13025A098), Maine Yankee Atomic Power Company (MYAPC, the licensee) requested changes to the Maine Yankee Atomic Power Station Operating License (OL) No. DPR-36.

The proposed amendment would change the title of the Physical Security Plan in the Yankee Nuclear Power Station Amended Facility OL, License Condition 2.B(6)(d) Physical Protection, from the Maine Yankee Nuclear Power Station Physical Security Plan, which includes the Contingency Plan and the Guard Training and Qualification Plan, to the Maine Yankee Independent Spent Fuel Storage Installation [ISFSI] Physical Security Plan.

2.0 BACKGROUND

The NRC previously reviewed the Maine Yankee Nuclear Power Station Physical Security Plan in 2009.

3.0 EVALUATION The proposed change is administrative in nature. The Maine Yankee Independent Spent Fuel Storage Installation Physical Security Plan is the current NRC-approved Physical Security Plan.

The proposed change does not reduce the commitments in the Physical Security Plan or adversely affect operation of the ISFSI.

4.0 STATE CONSULTATION

In accordance with the Commission's regulations, the Maine State official was notified of the proposed issuance of the amendment. The State official had no comments.

5.0 ENVIRONMENTAL CONSIDERATION

This amendment involves a change in an administrative requirement. Accordingly, this amendment meets the eligibility criteria for categorical exclusion set forth in 10 CFR 51.22(c)(10)(ii). Pursuant to 10 CFR 51.22(b) no environmental impact statement or environmental assessment need be prepared in connection with the issuance of the amendment.

6.0 CONCLUSION

The Commission has concluded, based on the considerations discussed above that: (1) there is reasonable assurance that the health and safety of the public will not be endangered by operation in the proposed manner, (2) such activities will be conducted in compliance with the Commissions regulations, and (3) the issuance of the amendment will not be inimical to the common defense and security or to the health and safety of the public.
