RE: PILGRIM WATCH'S 2.206 PETITION TO IMMEDIATELY SUSPEND THE OPERATING LICENSE OF PILGRIM STATION UNTIL THE PROVISIONS OF EA 050 AND EA-13-109 ARE FULLY IMPLEMENTED Hello Mary, The Petition Review Board (PRB) met on June 27, 2013, to consider the immediate action requested in your subject petition dated June 14, 2013. The PRB finds that there is no immediate safety concern to Pilgrim or to the health and safety of the public to warrant the requested immediate action (i.e., the immediate suspension of the Pilgrim operating license).

Additionally, as you reference in your petition, the NRC staff determined in the issuance of Order EA-13-050 and Order EA-13-109, that continued operation does not pose an imminent risk to public health and safety. The PRB does not identify any new or significant information in your petition that warrants the need to change this previous NRC determination in terms of an immediate suspension of Pilgrims operating license. Therefore, the PRBs decision is to deny your request for immediate action.

As you know, the 2.206 process allows you the opportunity to address the PRB prior to making its initial recommendation whether to accept or deny the petition for 2.206 review. I understand from your message below that you accept this offer. The PRB has tentatively scheduled a teleconference for you to address the PRB on July 15, 2013 from 1p - 2pm. Please let me know if you and your associates can support his date/time; I will provide you a dial-in no. once I confirm your availability.
