AVAILABILITY OF THE FINAL SUPPLEMENTAL ENVIRONMENTAL IMPACT STATEMENT REGARDING SOUTH TEXAS PROJECT, UNITS 1 AND 2, LICENSE RENEWAL

Dear Dr. Crabtree:

The U.S. Nuclear Regulatory Commission (NRC) has completed the enclosed final Supplement 48 to NUREG-1437, "Generic Environmental Impact Statement for License Renewal of Nuclear Plants" (SEIS), regarding the license renewal of South Texas Project, Units 1 and 2 (South Texas), in accordance with the National Environmental Policy Act of 1969, as amended (NEPA). With this letter, I am forwarding you a copy of the final SEIS, as well as the associated Federal Register notice of availability.

As part of its NEPA review, the NRC considered effects to species and habitats protected under the Endangered Species Act of 1973, as amended (ESA). The NRC determined that continued operation of South Texas during the license renewal term would have no effect on Federally listed species, proposed and candidate species, or critical habitat under the National Marine Fisheries Service's (NMFS's) jurisdiction. The NRC forwarded a copy of the draft SEIS, which documented its "no effect" determination, to NMFS for review in a letter dated December 10, 2012. Subsequently, in an e-mail dated January 29, 2013, Ms. Nicole Bailey, ESA Consultant, of your office confirmed that NMFS does not typically consult under section 7 of the ESA when a Federal agency determines that an action would have no effect. In preparing the final SEIS, the NRC staff did not identified any new information that would change its determination of "no effect." Thus, with the issuance the final SEIS, the NRC has fulfilled its obligations under section 7 of the ESA for species and habitats under NMFS's jurisdiction that could be affected by the proposed South Texas license renewal.

I have enclosed a copy of the final SEIS for your records. The NRC looks forward to coordinating with your office in the future to ensure the continued protected of Federally listed species and their habitats.
