KEWAUNEE POWER STATION REQUEST TO RECLASSIFY KEWAUNEE POWER STATION UNDER 10 CFR 171.15. "ANNUAL FEES: REACTOR LICENSES AND INDEPENDENT SPENT FUEL STORAGE LICENSES" By letter dated February 25, 2013, Dominion Energy Kewaunee, Inc. (DEK) notified the NRC of its intention to permanently cease power operations at Kewaunee Power Station (KPS) pursuant to 10 CFR 50.82(a)(1)(i) (Reference 1). On May 7, 2013, DEK permanently ceased power operation of KPS.
By letter dated May 14, 2013 (Reference 2), DEK certified that all fuel has been permanently removed from the KPS reactor vessel pursuant to 10 CFR 50.82(a)(1)(ii).
Upon docketing certifications for permanent cessation of operations and permanent removal of fuel from the reactor vessel, 10 CFR 50.82(a)(2) states that the 10 CFR Part 50 license no longer authorizes operation of the reactor or emplacement or retention of fuel into the reactor vessel. By letter dated May 29, 2013 (Reference 3), DEK submitted a request for amendment to modify the KPS license and Technical Specifications to reflect the permanently defueled condition of the plant.
DEK has previously submitted a Post-Shutdown Decommissioning Activities Report in accordance with the requirements of 10 CFR 50.82(a)(4)(i) (Reference 4) and an updated Irradiated Fuel Management Plan per the requirements of 10 CFR 50.54(bb)
(Reference 5).
Based on the above, Kewaunee Power Station is no longer an operating reactor.
Therefore, DEK requests that the NRC reclassify KPS with respect to 10 CFR 171.15, "Annual fees: Reactor licenses and independent spent fuel storage licenses."
Specifically, DEK requests that the NRC reclassify KPS as a "power reactor holding a 10 CFR Part 50 license that is in decommissioning or possession only status and has spent fuel stored on site" (see 10 CFR 171.15(c)(1)), and assess annual fees accordingly.
DEK has previously submitted payment of fees associated with KPS for the third fiscal quarter ending on June 30, 2013. Therefore, DEK requests that the NRC appropriately prorate the annual fees paid for the third fiscal quarter in accordance with 10 CFR 171.17(a)(2), "Terminations." DEK also requests that NRC billing of fees for the fourth fiscal quarter (July - September 2013) reflect the new classification of KPS under 10 CFR 171.15(c)(1).
