NRC STAFF MOTION FOR EXTENSION OF TIME TO FILE PETITION FOR REVIEW This morning, June 7, 2013, at approximately 8:15 am Eastern Time, Michael Johnson, Deputy Executive Director for Reactor and Preparedness Programs, received a call from Peter T. Dietrich, Senior Vice President and Chief Nuclear Officer, Southern California Edison.

Mr. Dietrich relayed that Southern California Edison would soon be informing its investors that it will not be seeking restart of either San Onofre Nuclear Generating Stations Unit 2 or Unit 3.

The company issued a press release this morning stating the same. 1 This is a significant development in this adjudicatory proceeding.

The deadline for parties to file a petition for review of LBP-13-7, pursuant to 10 C.F.R.

§ 2.341(b) is today. Therefore, pursuant to 10 C.F.R. § 2.323, the Staff of the Nuclear Regulatory Commission (Staff) respectfully requests a one week extension of time to Friday, June 14, to allow the Staff a reasonable opportunity to consider the implications of this development and determine an appropriate course of action.

In accordance with 10 C.F.R. § 2.323(b), the Staff has made a sincere effort to consult with the parties on this motion. The undersigned Counsel for NRC Staff has spoken by telephone with Counsel for Southern California Edison who does not object to this motion.

Counsel for Friends of the Earth (FOE) stated in an e-mail that FOE does not oppose this extension of time for the Staff to file a petition for review of LBP-13-7.
